عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ وَ سَهْلِ بْنِ زِيَادٍ جَمِيعاً عَنِ ابْنِ مَحْبُوبٍ عَنْ جَمِيلِ بْنِ دَرَّاجٍ عَنْ وَلِيدِ بْنِ صَبِيحٍ قَالَ:

شَكَوْتُ إِلَى أَبِي عَبْدِ اللَّهِ ع دَيْناً لِي عَلَى أُنَاسٍ فَقَالَ قُلِ اللَّهُمَّ لَحْظَةً مِنْ لَحَظَاتِكَ تَيَسَّرْ عَلَى غُرَمَائِي بِهَا الْقَضَاءَ وَ تَيَسَّرْ لِي بِهَا الِاقْتِضَاءَ إِنَّكَ عَلى‌ كُلِّ شَيْ‌ءٍ قَدِيرٌ*.

1. A number of our people have narrated from Ahmad ibn Muhammad and Sahl ibn Ziyad all from ibn Mahbub from Jamil ibn Darraj from Walid ibn Sabih who has said the following: “Once I complain to Abu ‘Abdillah (a.s.) about debts people owed to me.’ The Imam told me to say, ‘O Lord, provide an opportunity of Your opportunities in which it will be possible for my borrowers to pay and for me to receive payment. You have power over all things.’”

He (the Imam) said, ’Yes, he can do so.’”

A number of our people have narrated from Ahmad ibn Muhammad from ibn ‘Uthman ibn ‘Isa from abu al-Jarud from al-Asbagh Nubatah who has said the following: “I heard Amir al-Mu’minin (a.s.), saying from the pulpit, ‘O people who do business, you must learn fiqh (laws), then go in business, you must learn fiqh (laws) then go in business, you must learn fiqh (laws) then go in business. I swear by Allah, Riba ’ creeps in this nation more quietly than an ant’s moving on a hard and smooth rock. Blend your belief with truthfulness. A sinful business person is a criminal, and a criminal person is in the fire except those who take what is right and give what is right.’”

Ali ibn Ibrahim has narrated from his father from certain persons of his people from Ibn Abi ‘Umayr or others from ‘ Abd Allah ibn Sinan who has said the following: “I once heard abu ‘Abd Allah (a.s.), saying, ‘If a Muslim man passes by a people who do have not any valid authority and they force him, he fears for his life, to set free a slave or divorce and he complies, it does not have any valid effect against him/”

A number of our people have narrated from Sahl ibn Ziyad and Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad all from ibn Mahbub from ibn Ri’ab from abu ‘ Ubaydah who has narrated the following: “Abu Ja’far (a.s.), has said, The child involved in Mula‘anah (condemnation) of parents is inherited by his mother with a share of one-third and the rest of the legacy belongs to the Imam of the Muslims; the liability for his crime becomes a burden on the Imam.”’

أَتَى النَّبِيَّ ص رَجُلٌ فَقَالَ يَا نَبِيَّ اللَّهِ الْغَالِبُ عَلَيَّ الدَّيْنُ وَ وَسْوَسَةُ الصَّدْرِ فَقَالَ لَهُ النَّبِيُّ ص قُلْ تَوَكَّلْتُ‌ عَلَى الْحَيِّ الَّذِي لا يَمُوتُ‌ وَ الْحَمْدُ لِلَّهِ الَّذِي لَمْ يَتَّخِذْ صَاحِبَةً وَ لَا وَلَداً وَ لَمْ‌ يَكُنْ لَهُ شَرِيكٌ فِي الْمُلْكِ وَ لَمْ يَكُنْ لَهُ وَلِيٌّ مِنَ الذُّلِّ وَ كَبِّرْهُ تَكْبِيراً قَالَ فَصَبَرَ الرَّجُلُ مَا شَاءَ اللَّهُ ثُمَّ مَرَّ عَلَى النَّبِيِّ ص فَهَتَفَ بِهِ فَقَالَ مَا صَنَعْتَ فَقَالَ أَدْمَنْتُ مَا قُلْتَ لِي يَا رَسُولَ اللَّهِ فَقَضَى اللَّهُ دَيْنِي وَ أَذْهَبَ وَسْوَسَةَ صَدْرِي.

2. Al-Husayn ibn Muhammad al-Ash’ari has narrated from Mu’alla ibn Muhammad from al-Hassan ibn Ali al-Washsha’ from Hammad ibn ‘Uthman from Abu ‘Abdillah (a.s.) who has said the following: “Once a man came to the Holy Prophet and said, ‘O Prophet of Allah, debts and insinuation of the chest (mind) have overcome me.’ The Holy Prophet told him to say, ‘I place my trust in Allah, the Living, Who does not die, all praise belongs to Allah, Who has not taken any companions, or children. Who has no partner in His kingdom or supporter against defeat, and you must say that Allah is greater than can be described. ’ “The Imam said that he thereafter passed by the Holy Prophet who asked him how was he doing. He replied, ‘I continued practicing what you had preached, O the Messenger of Allah, Allah enabled me to pay my debts and removed the insinuation from my chest.’”

2. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from ‘Umar ibn ‘Udhaynah from Zurarah who has said the following: “I once asked abu Ja‘far (a.s.), about the divorce of a man who is coerced and about his setting free slaves. He (the Imam) said, ‘His divorce is not a divorce and his setting free slaves is not valid freedom/ I then said, ‘I am a merchant and I pass by a one-tenth tax collector, with certain amount of assets with me/ He (the Imam) said, ‘Keep it concealed as much as you can in their proper place/ I then asked, ‘What must I do if they ask me to swear about divorce and setting free slaves?’ He (the Imam) said, ‘You can swear for him.’ He (the Imam) then took a piece of date and immersed it in butter in front of him (the Imam).’ He (the Imam) then said, ‘I do not mind about your swearing for divorce and setting free slaves or eating this.’”

3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn Sinan from Muskan from abu Hamza al-Thumali from Abu ‘Abdillah (a.s.) who has said the following: “Once a man came to the Holy Prophet and said, ‘O Messenger of Allah, I face a strong insinuation in my chest (mind) and I am a man with a family, indebted and needy.’ The Messenger of Allah told him to repeat these words: ‘I place my trust in the Living One, Who does not die, all praise belongs to Allah, Who has not taken any companion, or children. Who has no partner in His Kingdom, and no guardian against defeat and you must say that He is greater than can be described.’ Shortly thereafter he came and said, ‘Allah has removed the insinuation from my chest, enabled me to pay my debts and has increased my sustenance.’”

سَأَلْتُ الْعَبْدَ الصَّالِحَ ع وَ هُوَ بِالْعُرَيْضِ فَقُلْتُ لَهُ جُعِلْتُ فِدَاكَ إِنِّي قَدْ تَزَوَّجْتُ امْرَأَةً وَ كَانَ تُحِبُّنِي فَتَزَوَّجْتُ عَلَيْهَا ابْنَةَ خَالِي وَ قَدْ كَانَ لِي مِنَ الْمَرْأَةِ وَلَدٌ فَرَجَعْتُ إِلَى بَغْدَادَ فَطَلَّقْتُهَا وَاحِدَةً ثُمَّ رَاجَعْتُهَا ثُمَّ طَلَّقْتُهَا الثَّانِيَةَ ثُمَّ رَاجَعْتُهَا ثُمَّ خَرَجْتُ مِنْ عِنْدِهَا أُرِيدُ سَفَرِي هَذَا حَتَّى إِذَا كُنْتُ بِالْكُوفَةِ أَرَدْتُ النَّظَرَ إِلَى ابْنَةِ خَالِي فَقَالَتْ أُخْتِي وَ خَالَتِي لَا تَنْظُرُ إِلَيْهَا وَ اللَّهِ أَبَداً حَتَّى تُطَلِّقَ فُلَانَةَ فَقُلْتُ وَيْحَكُمْ وَ اللَّهِ مَا لِي إِلَى طَلَاقِهَا سَبِيلٌ فَقَالَ لِي هُوَ مِنْ شَأْنِكَ لَيْسَ لَكَ إِلَى طَلَاقِهَا سَبِيلٌ فَقُلْتُ جُعِلْتُ فِدَاكَ إِنَّهُ كَانَتْ لِي مِنْهَا بِنْتٌ وَ كَانَتْ بِبَغْدَادَ وَ كَانَتْ هَذِهِ بِالْكُوفَةِ وَ خَرَجْتُ مِنْ عِنْدِهَا قَبْلَ ذَلِكَ بِأَرْبَعٍ فَأَبَوْا عَلَيَّ إِلَّا تَطْلِيقَهَا ثَلَاثاً وَ لَا وَ اللَّهِ جُعِلْتُ فِدَاكَ مَا أَرَدْتُ اللَّهَ وَ مَا أَرَدْتُ إِلَّا أَنْ أُدَارِيَهُمْ عَنْ نَفْسِي وَ قَدِ امْتَلَأَ قَلْبِي مِنْ ذَلِكَ جُعِلْتُ فِدَاكَ فَمَكَثَ طَوِيلًا مُطْرِقاً ثُمَّ رَفَعَ رَأْسَهُ إِلَيَّ وَ هُوَ مُتَبَسِّمٌ فَقَالَ أَمَّا مَا بَيْنَكَ وَ بَيْنَ اللَّهِ عَزَّ وَ جَلَّ فَلَيْسَ بِشَيْ‌ءٍ وَ لَكِنْ إِذَا قَدَّمُوكَ إِلَى السُّلْطَانِ أَبَانَهَا مِنْكَ.

Humayd ibn Ziyad has narrated from ibn Sama‘ah from ‘Ubays ibn Hisham and Salih ibn Khalid from Mansur ibn Yunus who has said the following: “I once asked Allah’s virtuous servant (a.s.), when he was in al-‘Arid, (name of a place) saying, ‘I pray to Allah to keep my soul in service for your cause, I married a woman who loved me. I then married the daughter of my maternal uncle and from the woman I had a son. I returned to Baghdad and divorced her once, then I went back to her, then divorced her for the second time, then I went back to her and then left for this journey. I arrived in al-Kufah to see the daughter of my maternal uncle, and my sister and maternal aunt told me that, by Allah, I could never look at her until I divorced so and so. I then told them: ‘Fie on you; I have no way to divorce her.’ He said, ‘It is up to you and it is your problem.’ I then said, ‘I pray to Allah to keep my soul in service for your cause. From her I had a daughter who lived in Baghdad and this is in al-Kufah; I had left her before four and they refused to allow me to see her unless I divorced her three times. No, by Allah, I pray to Allah to keep my soul in service for your cause, I did not want to do so except that I wanted to keep them away from myself, and my heart has become full (of disappointment with them). I pray to Allah to keep my soul in service for your cause.’ He (the Imam) then bent down his head for a long time, then raised his head, smiling and said, ‘Between you and Allah, most Majestic, most Glorious, there is no problem, however, if they take their case against you before the Sultan (ruling authorities) they can make her to become stranger to you.’”

Ali ibn Ibrahim has narrated from his father from ‘Abd Allah ibn al-Mughirah from Musa ibn Bakr who has said the following: “Abu Ibrahim (a.s.) had written the following for me on a piece of paper: ‘O Lord, return to all of such of Your creatures whose usurped belongings may exist with me, in small or large amounts, with ease and good health and for whatever of such items that my ability, body, certainty, my soul and belongings are not sufficient, enough and able, pay and fulfill them on my behalf from the abundance with You, through Your generosity. Do not leave on me anything (debts) that You will pay off from my good deeds, O the Most Beneficent, of the beneficent ones. I testify that no one deserves to be worshipped except Allah, Who has no partner, and I testify that Muhammad is His servant and messenger that religion is as He has sanctioned that Islam is as He has described that the book is as He has revealed, that the word is as He has spoken, that Allah is the clear Truth. Allah has mentioned Muhammad and his family with words of goodness and has greeted Muhammad and his family with the greeting of peace.’”

4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from Yahya ibn ‘Abd Allah ibn af-Hassan who has said the following: “I once heard abu ‘Abd Allah (a.s.), saying, ‘Divorce under coercion is not permissible or setting free of a slave. It is not permissible to swear for cutting off good relations with relatives or for a sinful act in disobedience to Allah. Thus, whoever swears or is made to swear about something of this kind, it does not have any valid effect on him. Divorce is what is meant to be divorce, and without coercion or harming in a divorce in the manner of waiting period, according to the Sunnah, in a Hayd (menses)-free period, without sexual intercourse and is pronounced in the presence of two witnesses. If one opposes this, his divorce and oath do not have any valid effect and it is returned to the book of Allah, most Majestic, most Glorious.’”

A number of our people have narrated from Ahmad ibn abu ‘Abd Allah, from his father from Khalaf from Hammad from Al-Husayn ibn Zayd al-Hashimiy who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘Once Zaynab al-‘Attarah al-Hawla’ visited the wives of the Holy Prophet, and the Holy Prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, also came home when she was with his wives. The Holy Prophet said, ‘When you visit our houses they become full of sweet smelling fragrance.’ She then responded saying, ‘Your houses with your own fragrance are the best, O the Messenger of Allah.’ The Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, then said, ‘When you sell perfumes, you must make certain it is not adulterated; maintaining a greater degree of piety before Allah is more protection for wealth.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Mu‘awiyah ibn Wahab from ’Isma‘il al-Ju‘fiy who has said the following: “I pass by one-tenth tax collector for trading with a certain amount of assets with me and the party (tax collector) asks me to swear. If I swear he allows me to go, but if I do not swear he searches my assets and does injustice to me. He (the Imam) said, ‘You can swear for him.’ I then said, ‘He asks me to swear in the issue of divorce. He (the Imam) said, ‘You can swear for him.’ I said, ‘The asset does not belong to me.’ He (the Imam) said, ‘Do it for the assets of your brother. The Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, reversed the divorce of ibn ‘Umar, who had divorced his wife three times during her Hayd (menses) and the Messenger of Allah considered it invalid and devoid of valid effect.’”

Ali ibn Muhammad has narrated from Ibrahim ibn Ishaq al-Ahmar from ‘Abd Allah ibn Hammad from ‘Abd Allah ibn Sinan who has said the following: “I once asked him (the Imam) (a.s.), about a man who experiences sexual relation with his slave-girl on a journey in the month of Ramadan during the day. He (the Imam) said, ‘He has not recognized any respect for the month of Ramadan even though there is a long time during the night.’” NOTE: Al-Kulayniy has said that it is better for one to pay respect to the month of Ramadan and abstain from sexual relation during the day. However, if one is overpowered by lust and is afraid from his soul in which case it is permissible to have what is lawful. It is as is permissible for a traveler who does not find water, when desire overpowers him, to have what is lawful. He has said that one receives rewards for it just as it is a sin when he commits something unlawful.

Al-Husayn ibn Muhammad has narrated from Mu’alla’ ibn Muhammad from certain persons of our people from Aban from ‘Amir ibn Juza‘ah who has said the following: “I (the narrator) once asked abu ‘Abd Allah (a.s.), about a man who had set a price on a certain item of his merchandise. Thereafter whoever purchased that merchandise without asking for any discount, he sold it to them for the same price; but those who asked for a discount he instead increased the price. He (the Imam) said, ‘There is no offense in such increases for two or three men, but if he does so with everyone who asks for a discount then I do not like his selling but for one and the same price.’”

Ahmad has narrated from Ali from Ahmad ibn Ishaq ibn Sa‘d al-Ash’ariy from ‘Abd Allah ibn Sa‘id al-Daghshiy who has said the following: “Once I was at the door of Shihab ibn ‘Abde Rabbihi when the slave of Shihab came out and said, ‘I want to ask Hashim al-Saydananiy about the Hadith on “price and merchandise.’” He (the narrator) has said, ‘I then visited Hashim and asked him about that Hadith.’ He (Hashim) said, “I asked abu ‘Abd Allah (a.s.), about this Hadith and he (the Imam) said, ‘Yes, whoever has a merchandise or goods with him, Allah, most Majestic, most Glorious, sends someone to profit him. He may accept such profit, otherwise, it is turned away from him to others; it is a rejection of the favor of Allah, most Majestic, most Glorious.”””

I request you to set for me a limit, how should I deal with them in a transaction so that I will not go beyond that limit.’ He (the Imam) said, ‘If you consider your brother (in belief) as the person in charge it is fine, otherwise, deal with him in a transaction as one deals with a well aware hairsplitting person.”’

They yield to the rights of Allah in such times.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn Yahya from Talhah ibn Zayd who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘Amir al-Mu’minin (a.s.), has said, ‘If one does business without knowledge, he plunges in Riba ’ again and again.’ Amir al-Mu’minin (a.s.), would also say, ‘One who does not understand buying and selling must not sit in the market place for doing business.’”

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ الرَّجُلِ يُسَافِرُ فِي شَهْرِ رَمَضَانَ وَ مَعَهُ جَارِيَةٌ لَهُ فَلَهُ أَنْ يُصِيبَ مِنْهَا بِالنَّهَارِ فَقَالَ سُبْحَانَ اللَّهِ أَ مَا تَعْرِفُ حُرْمَةَ شَهْرِ رَمَضَانَ إِنَّ لَهُ فِي اللَّيْلِ سَبْحاً طَوِيلًا قُلْتُ أَ لَيْسَ لَهُ أَنْ يَأْكُلَ وَ يَشْرَبَ وَ يُقَصِّرَ فَقَالَ إِنَّ اللَّهَ تَبَارَكَ وَ تَعَالَى قَدْ رَخَّصَ لِلْمُسَافِرِ فِي الْإِفْطَارِ وَ التَّقْصِيرِ رَحْمَةً وَ تَخْفِيفاً لِمَوْضِعِ التَّعَبِ وَ النَّصَبِ وَ وَعْثِ السَّفَرِ وَ لَمْ يُرَخِّصْ لَهُ فِي مُجَامَعَةِ النِّسَاءِ فِي السَّفَرِ بِالنَّهَارِ فِي شَهْرِ رَمَضَانَ وَ أَوْجَبَ عَلَيْهِ قَضَاءَ الصِّيَامِ‌ وَ لَمْ يُوجِبْ عَلَيْهِ قَضَاءَ تَمَامِ الصَّلَاةِ إِذَا آبَ مِنْ سَفَرِهِ ثُمَّ قَالَ وَ السُّنَّةُ لَا تُقَاسُ وَ إِنِّي إِذَا سَافَرْتُ فِي شَهْرِ رَمَضَانَ مَا آكُلُ إِلَّا الْقُوتَ وَ مَا أَشْرَبُ كُلَّ الرِّيِّ.

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from al-Hassan ibn Mahbub from ibn Sinan who has said the following: “I once asked abu ‘Abd Allah, ‘Alayhi al-Salam, about a man who travels in the month of Ramadan and with him there is his slave-girl: if he can experience sexual relation with her during the day in the month of Ramadan. He (the Imam) said, ‘Allah is free of all defects. Does he not recognize any respect for the month of Ramadan and that during the night there is a long time for him?’ I then asked, ‘Can he not eat, drink and reduce his Salat (prayer)?’ He (the Imam) said, ‘Allah, most Blessed, most High, has granted permission to stop fasting and reduce one’s Salat (prayer) while on a journey. It is as a mercy and to provide ease for him; he becomes tired because of the difficulties of traveling. He has not granted permission to have sexual relation with a woman on a journey during the day in the month of Ramadan. He has made Qada’ (compensatory fast) of the fast of the month of Ramadan obligatory on him but He has not made Qada’ (compensatory) Salat (prayer) in complete form obligatory when he returns from his journey.’ He (the Imam) then said, ‘It is not permissible to measure the Sunnah by means of analogy. When I travel in the month of Ramadan I do not eat more than bare necessities and do not drink to completely quench my thirst.’”

2. Ali ibn Ibrahim has narrated from his father from al-Nawfaliy from al-Sakuniy, who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said that the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has said, ‘One who buys and sells must not engage in five things; otherwise, one must not engage in business of buying and selling: One must stay away from Riba’, swearing, hiding defects in the merchandise, admiring the merchandise when selling and belittling it when buying.’”

كَانَ أَمِيرُ الْمُؤْمِنِينَ ع بِالْكُوفَةِ عِنْدَكُمْ يَغْتَدِي كُلَّ يَوْمٍ بُكْرَةً مِنَ الْقَصْرِ فَيَطُوفُ فِي أَسْوَاقِ الْكُوفَةِ سُوقاً سُوقاً وَ مَعَهُ الدِّرَّةُ عَلَى عَاتِقِهِ وَ كَانَ لَهَا طَرَفَانِ وَ كَانَتْ تُسَمَّى السَّبِيبَةَ فَيَقِفُ عَلَى أَهْلِ كُلِّ سُوقٍ فَيُنَادِي يَا مَعْشَرَ التُّجَّارِ اتَّقُوا اللَّهَ عَزَّ وَ جَلَّ فَإِذَا سَمِعُوا صَوْتَهُ ع أَلْقَوْا مَا بِأَيْدِيهِمْ وَ أَرْعَوْا إِلَيْهِ بِقُلُوبِهِمْ وَ سَمِعُوا بِآذَانِهِمْ فَيَقُولُ ع قَدِّمُوا الِاسْتِخَارَةَ وَ تَبَرَّكُوا بِالسُّهُولَةِ وَ اقْتَرِبُوا مِنَ الْمُبْتَاعِينَ وَ تَزَيَّنُوا بِالْحِلْمِ وَ تَنَاهَوْا عَنِ الْيَمِينِ وَ جَانِبُوا الْكَذِبَ وَ تَجَافَوْا عَنِ الظُّلْمِ وَ أَنْصِفُوا الْمَظْلُومِينَ وَ لَا تَقْرَبُوا الرِّبَا وَ أَوْفُوا الْكَيْلَ وَ الْمِيزانَ وَ لا تَبْخَسُوا النَّاسَ أَشْياءَهُمْ‌ ... وَ لا تَعْثَوْا فِي الْأَرْضِ مُفْسِدِينَ* فَيَطُوفُ ع فِي جَمِيعِ أَسْوَاقِ الْكُوفَةِ ثُمَّ يَرْجِعُ فَيَقْعُدُ لِلنَّاسِ.

3. A number of our people have narrated from Sahl ibn Ziyad and Ahmad ibn Muhammad from and Ali ibn Ibrahim has narrated from his father all from ibn Mahbub from ‘Amr ibn abu al-Miqdam from Jabir, who has said the following: “Abu Ja’far, ‘Alayhi al-Salam, has said that ’Amir al-Mu’minin, ‘Alayhi al-Salam, lived among you in al-Kufah. He would have one loaf of bread everyday for his lunch and walk in market-places of al- Kufah one by one with a durrah (whip) on his shoulder. It had two strips and it was called al- Sababiyah. He addressed the people of every market-place and said, ‘Those people who do business must maintain piety before Allah, most Majestic, most Glorious.’ People on hearing his voice dropped down whatever they had in their hands, their hearts repented and their ears listened. He (the Imam) would say, ‘You must seek goodness (from Allah) and conclude a transaction with ease, stay close to buyers, dress up with forbearance, stay away from swearing, lying and injustice. Exercise fairness with the oppressed and do not become close to Riba’. Maintain proper measurement and balance. You must not reduce people’s things and you must not spread corruption in the land.’ He (the Imam) would walk in all of market-places of al-Kufah and then return to meet people.”
