1. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hisham ibn al-Hakam who has said the following: “About people found dead because of a sudden shock or drowned, abu al-Hassan (a.s.), has said to wait three days unless a change in their condition takes place earlier.’”

مِنْ تَمَامِ الْحَجِّ وَ الْعُمْرَةِ أَنْ تُحْرِمَ مِنَ الْمَوَاقِيتِ الَّتِي وَقَّتَهَا رَسُولُ اللَّهِ ص وَ لَا تُجَاوِزَهَا إِلَّا وَ أَنْتَ مُحْرِمٌ فَإِنَّهُ وَقَّتَ لِأَهْلِ الْعِرَاقِ وَ لَمْ يَكُنْ يَوْمَئِذٍ عِرَاقٌ بَطْنَ الْعَقِيقِ مِنْ قِبَلِ أَهْلِ الْعِرَاقِ‌ وَ وَقَّتَ لِأَهْلِ الْيَمَنِ يَلَمْلَمَ وَ وَقَّتَ لِأَهْلِ الطَّائِفِ قَرْنَ الْمَنَازِلِ وَ وَقَّتَ لِأَهْلِ الْمَغْرِبِ الْجُحْفَةَ وَ هِيَ مَهْيَعَةُ وَ وَقَّتَ لِأَهْلِ الْمَدِينَةِ ذَا الْحُلَيْفَةِ وَ مَنْ كَانَ مَنْزِلُهُ خَلْفَ هَذِهِ الْمَوَاقِيتِ مِمَّا يَلِي مَكَّةَ فَوَقْتُهُ مَنْزِلُهُ.

1. Ali ibn Ibrahim has narrated from his father from Ahmad ibn Muhammad from Muhammad ibn ‘Isma‘il has narrated from al-Fadl ibn Shadhan from Ibn Abi ‘Umayr and from Safwan ibn Yahya Mu‘awiyah ibn ‘Ammar who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘It is of the completion of al-Hajj and al-‘Umrah to assume the state of Ihram from Miqat (place for assuming the state of Ihram) which are designated by the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause. You must not pass them without assuming the state of Ihram. For the people of Iraq, he (the Messenger of Allah) assigned a place, and there were no people of Iraq, which is Batn al-‘Aqiq. In those days there was no Iraq. Batn al-‘Aqiq was for people from the direction of Iraq. He (the Messenger of Allah) designated Yalamlam for people of Yemen. Qarn al-Manazil is for people of Ta’if. Al-Juhfah is for people of al-Maghrib and it is Mahya‘. He (the Messenger of Allah) designated Dhu al-Hulayfah for people of al-Madinah. Those whose homes are behind these Mawaqit (places for assuming the state of Ihram) toward Makkah then their home is Miqat (place for assuming the state of Ihram) for them.”’

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from al-‘Ala’ ibn Razin from Muhammad ibn Muslim who has said the following: “One of the two Imam, (abu Ja’far or abu ‘Abd Allah), ‘Alayhim al-Salam, was asked about the case of a man who went to bed with a woman out of wedlock; if he could marry her daughter. He (the Imam) said, ‘No, however, if a woman is his wife and he goes to bed with her mother or her daughter or sister, his wife does not become unlawful for him because unlawful does not destroy what is lawful. 5 ”

2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from Ali ibn al-Hakam from Sayf ibn ‘Amirah from Ishaq ibn ‘Ammar who has said the following: “I once asked him (the Imam) (a.s.), if there is Ghusl (bath) for one who has died because of drowning. He (the Imam) said, ‘Yes, there is Ghusl (bath) and he is freed (of doubtful condition).’ I then asked, ‘How is he freed?’ He (the Imam) said, ‘He is left for three days before burial and so also is the case of one found dead because of a sudden shock. People think he is dead, perhaps he is not dead.’”

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘Mawaqit (places for assuming the state of Ihram) are five, which were designated as Miqat by the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause. It is not proper for one who performs al-Hajj or al-‘Umrah to assume the state of Ihram before or after passing these places. For the people of al-Madinah, it is Dhul Hulayfah. It is Masjid al-Shajarah where one performs Salat (prayer) and makes al-Hajj obligatory. For the people of al-Sham, it is al-Juhfah and for people of Najd he (the Messenger of Allah) designated al-‘Aqiq. For the people of Ta’if he (the Messenger of Allah) designated Qarn al-Manazil, for people of Yemen he (the Messenger of Allah) designated Yalamlam. It is not proper for one not to assume the state of Ihram from places the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to your cause, has designated.”

[1]قال سيد المحققين: ظاهر المحقق و العلامة في كتبه أن ميقات أهل المدينة نفس مسجد الشجرة و جعل بعضهم: الميقات الموضع المسمى بذى الحليفة و يدلّ عليه اطلاق عدة من الاخبار الصحيحة لكن مقتضى صحيحة الحلبيّ أن ذى الحليفة عبارة عن نفس المسجد و على هذا فتصير الاخبار متفقة و يتعين الاحرام من المسجد. انتهى. و يحتمل أن يكون المراد هو الموضع الذي فيه مسجد الشجرة و لا ريب أن الاحرام من المسجد أولى و أحوط.( آت)ص 319

Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar and Muhammad ibn ‘Isma’il has narrated from al-Fadl ibn Shadhan from all from Safwan ibn Yahya from ‘Is ibn al-Qasim who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who associates with a woman and kisses her but does not go to bed with her; if he can marry her daughter. He (the Imam) said, ‘If he has not gone to bed with the mother, it is not unlawful to marry her but if he has gone to bed with her mother then he must not marry her (the daughter).’”

A number of our people have narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Dawud ibn al-Nu’man from abu Ayyub al-Khazzaz who has said the following: “I once asked abu ‘Abd Allah (a.s.), about al-‘Aqiq if it was designated by the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, or that people have done something about it. He (the Imam) said, ‘The Messenger of Allah designated Dhu al-Hulayfah for the people of al-Madinah, for the people of al-Maghrib he (the Messenger of Allah) designated al-Juhfah and this is written with us as Mahya‘ah. For the people of Yemen, he (the Messenger of Allah) designated Yalamlam; Qarn al-Manazil is for people of Ta’if and for the people of Najd is al-‘Aqiq and also for those who come from Najd.’”

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “About the case of a man who marries a girl then goes to bed with her, then due to wickedness goes to bed with her mother; if she becomes unlawful for him, abu Ja‘far (a.s.), has said, ‘His wife does not become unlawful for him.’ He (the Imam) then said, ‘Unlawful never makes a lawful thing unlawful.’”

Muhammad ibn Yahya has narrated from Muhammad ibn Ahmad ibn al-Hassan from ‘Amr ibn Sa‘id from Musaddiq ibn Sadaqah from ‘Ammar who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘One who has died because of drowning is kept until there is a change and his death becomes certain; then his Ghusl (bath) and shroud are done.’ He (the narrator) has said that he (the Imam) was asked about one who has died because of a sudden shock. He (the Imam) said, ‘If it (death) is because of sudden shock, he is kept for two days, then his Ghusl (bath) and shroud are done.’”

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from ibn ‘Udhaynah from Zurarah who has said the following: “About the case of a man who goes to bed with his mother-in-law or his stepdaughter or her sister, abu Ja’far ‘Alayhi al-Salam, has said, ‘This does not make his wife unlawful for him.’ He (the Imam) then said, ‘Unlawful does not make a lawful thing unlawful.’”

Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan from Mansur ibn Hazim who has said the following: “About the case of a man and a woman who are involved in sinful activities; if he can marry her daughter, abu ‘Abd Allah (a.s.), has said, ‘If such activities are in the form of kissing or similar things he can marry her daughter; but if it is sexual intercourse then he must not marry her daughter, he can, however, marry the woman if he wants.’”

Ahmad ibn Mehran has narrated from Muhammad ibn Ali from Ali ibn abu Hamzah who has said the following: “In one of the years many people in Makkah died because of a great deal of lightning and thunder. I visited abu Ibrahim (a.s.), and he, without asking, initiated stating, ‘It is proper to delay for three days the burial of one who has died because of drowning and sudden shock unless the spread of smell proves his death.’ I then said, ‘I pray to Allah to keep my soul in service for your cause, are you telling me that many people are buried alive? He (the Imam) said, ‘Yes, O Ali, many people were buried alive and they did not die but in their graves.’”

A number of our people have narrated from Ahmad ibn Muhammad from al-Fiassan ibn Mahbub from ‘Abd Allah ibn Sinan who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘One who stays in al-Madinah for one month, then wants to perform al-Hajj; but he decides to travel from a road other than the road of the people of al- Madinah, his Ihram is from a distance of six miles, parallel to al-Shajarah in al-Bayda’. In another Hadith it says that one assumes the state of Ihram from al-Shajarah and travels whichever way he wants.’”

Ibn Mahbub has narrated from Hisham ibn Salim from Yazid al-Kunnasiy who has said the following: “A certain person of our people married a woman and said to me, ‘I like if you ask abu ‘Abd Allah (a.s.), about the case of a man from our people who has married a woman and thinks that he may have played with her mother like kissing without sexual intercourse.’ He (the narrator) has said, ‘I asked abu ‘Abd Allah (a.s.), about it and he said, ‘He has lied. Tell him to separate from her.’ I returned from my journey and informed the man of what abu ‘Abd Allah (a.s.), had said. By Allah, he did not defend himself and sent her to go away.’”

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Mu‘awiyah ibn ‘Ammar who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘The beginning of al-‘Aqiq is Barid al-Ba‘th, and it is six miles before al-Maslakh from the side of Iraq; between this and Ghamrah there is twenty four miles and two Barid.’” “Certain persons of our people have said, ‘When you come out of al-Maslakh, then assume the state of Ihram at the first Barid.’” (Ahadith 3-10 of previous Chapter are best explained by means of fatwa either because they speak of the same issue with only different narrators or that expressing their precise meaning requires expert’s opinion).

10. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from abu Ayyub al-Khazzaz from Muhammad ibn Muslim who has said the following: “Once, a man asked abu ‘Abd Allah (a.s.), when I was sitting, about the case of a man who when young was involved with his maternal aunt then refrained, if he could marry her daughter. He (the Imam) said, ‘No, he cannot do so.’ He then asked, ‘What happens if there was no sexual intercourse, but it was something near the thing?’ He (the Imam) said, ‘No, his words are not accepted, and it is not honorable.’”

[1]كانه عليه السلام علم كذبه في ذلك فأخير به كالخبر السابق فلا يكون الحكم مطردا و قطع الاصحاب بحرمة بنت العمة و الخالة بالزنا السابق بامها و جعلوها مستثنى من الحكم بعدم التحريم بالزنا السابق و الرواية انما تضمنت حكم الخالة فالحاق العمة بها يحتاج إلى دليل لكن الاخبار العامّة كاف في اثبات ذلك فيهما و في غيرهما كما مر.( آت)ص 417

Ali ibn Ibrahim has narrated from Muhammad ibn ‘Isa from Yunus from ’Isma‘il ibn ‘Abd Allah al-Khaliq, brother of Shihab ibn ‘Abd Rabbihi who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Burial is delayed, unless there is a change, because of five kinds of reasons for death: Death because of drowning, sudden shock, internal (illness pain), crushed and smoke (fumigation).”’
