كَانَ أَمِيرُ الْمُؤْمِنِينَ ص يَحْبِسُ الرَّجُلَ إِذَا الْتَوَى عَلَى غُرَمَائِهِ ثُمَّ يَأْمُرُ فَيَقْسِمُ مَالَهُ بَيْنَهُمْ بِالْحِصَصِ فَإِنْ أَبَى بَاعَهُ فَيَقْسِمُ يَعْنِي مَالَهُ‌[1].

“Abu ‘ Abd Allah (a.s.), has said that ‘Amir al-Mu’minin (a.s.), would keep in custody a procrastinating debtor; then command to distribute his assets among his creditors proportionate to their shares, and if he (the debtor) disagreed, he (the Imam) sold his assets, then distributed it among his creditors.’”

“Abu ‘ Abd Allah (a.s.), has said that once a man who had presented his person to bail out another man was brought before ‘Amir al-Mu’minin who placed him in custody and commanded him to present the man whom he had bailed out.’”

“I heard abu ‘Abd Allah (a.s.), saying, ‘You must maintain piety before Allah and you must return a trust to the one who has entrusted you with it. Even if the assassin of Ali ibn abu Talib entrusted me with something, I had to return it to him safely.’”

مَرَّ أَمِيرُ الْمُؤْمِنِينَ ع عَلَى جَارِيَةٍ قَدِ اشْتَرَتْ لَحْماً مِنْ قَصَّابٍ وَ هِيَ تَقُولُ زِدْنِي فَقَالَ لَهُ أَمِيرُ الْمُؤْمِنِينَ صَلَوَاتُ اللَّهِ عَلَيْهِ زِدْهَا فَإِنَّهُ أَعْظَمُ لِلْبَرَكَةِ.

“Amir al-Mu’minin (a.s.), once said to a butcher about a slave-girl who had purchased meat from his shop and who was asking for more, ‘You must give her more; it has greater blessings.’”

‘If one does business without knowledge, he plunges in Riba ’ again and again.’ Amir al-Mu’minin (a.s.), would also say, ‘One who does not understand buying and selling must not sit in the market place for doing business.’”

‘The market-place of Muslims is like their Masjid. Whoever comes first to a place in it is more rightful than others to benefit thereof.’ He did not charge any rent for the use of houses of the market-place.’”

“Amir al-Mu’minin (a.s.), once stood on the house of ibn abu Mu‘ayt where camel men stayed, and said, ‘O middlemen people, you must reduce swearing; it makes a merchandise easily marketable but destroys the profit.’”

“I once asked abu Basir to ask abu ‘ Abd Allah (a.s.), about the case of a man who exchanges two baskets of fresh half-ripe dates for one basket of Mushaqaq (stone-free) dates. Abu Basir asked him (the Imam) and he (the Imam) said, ‘It is Makruh (detestable).’ Abu Basir then asked, ‘Why it is Makruh (detestable)?’ He (

إِنَّ أَمِيرَ الْمُؤْمِنِينَ ع قَالَ: فِي الْأَرْضِ الْبُورِ[2] يَرْتَهِنُهَا الرَّجُلُ لَيْسَ فِيهَا ثَمَرَةٌ فَزَرَعَهَا وَ أَنْفَقَ عَلَيْهَا مَالَهُ إِنَّهُ يَحْتَسِبُ لَهُ نَفَقَتَهُ وَ عَمَلَهُ خَالِصاً ثُمَّ يَنْظُرُ نَصِيبَ الْأَرْضِ فَيَحْسُبُهُ مِنْ مَالِهِ الَّذِي ارْتَهَنَ بِهِ الْأَرْضَ حَتَّى يَسْتَوْفِيَ مَالَهُ فَإِذَا اسْتَوْفَى مَالَهُ فَلْيَدْفَعِ الْأَرْضَ إِلَى صَاحِبِهَا.

“Abu Ja’far (a.s.), has said that ’Amir al-Mu’minin has said, ’If one uses a certain amount of assets in business with stipulation for half of the profit, he is not liable.’ He (the Imam) also said, ‘One who holds a merchant responsible he can only have his capital and has no share in the profit.’”

“Abu ‘Abd Allah (a.s.), has said that about the case of a man who owed a certain amount of assets to another man who demanded it but he did not have it, then told him to keep it as capital for Mudarabah (profit sharing), ’Amir al-Mu’minin, has said, ‘It is not valid until he takes possession.’”

“Abu ‘Abd Allah (a.s.), has said that ’Amir al-Mu’minin, about Mudarabah (profit sharing), has said, ‘Whatever he spends during his journey is from the whole of the capital, but when he is back home then whatever he spends is from his own share.’”

“Abu ‘Abd Allah (a.s.), has said that ‘Amir al-Mu’minin would hold cleaners, jewelers and dyers liable as precautionary measure to protect the interests of the people; but he would not hold them liable for things burnt or drowned. “Abu ‘Abd Allah (a.s.), has said that ‘Amir al-Mu’minin, issued judgment in favor of a man whose slave was hired by a goldsmith or another man. The judgment said, ‘If he has caused certain damage or has run away with something, the masters are held responsible. 5 ”

One of them had purchased a camel from the other one, and the seller had excluded the head and the skin. The buyer then decided to sell it. He (the Imam) said to the buyer, ‘His share in the camel is proportion
