Ali ibn Ibrahim has narrated from his father from al-Nawfali from al-Sakuni from abu ‘Abdallah (a.s.) who has said the following. “The holy Prophet (s.a.), “Over every truth there is a reality and above every valid issue there is light. Whatever agrees with the holy Quran you must follow it and whatever does not agree disregard it.”

مَا مِنْ شَيْ‌ءٍ إِلَّا وَ لَهُ حَدٌّ يَنْتَهِي إِلَيْهِ إِلَّا الذِّكْرَ فَلَيْسَ لَهُ حَدٌّ يَنْتَهِي إِلَيْهِ فَرَضَ اللَّهُ عَزَّ وَ جَلَّ الْفَرَائِضَ فَمَنْ أَدَّاهُنَّ فَهُوَ حَدُّهُنَّ وَ شَهْرَ رَمَضَانَ فَمَنْ صَامَهُ فَهُوَ حَدُّهُ وَ الْحَجَّ فَمَنْ حَجَّ فَهُوَ حَدُّهُ إِلَّا الذِّكْرَ فَإِنَّ اللَّهَ عَزَّ وَ جَلَّ لَمْ يَرْضَ مِنْهُ بِالْقَلِيلِ وَ لَمْ يَجْعَلْ لَهُ حَدّاً يَنْتَهِي إِلَيْهِ ثُمَّ تَلَا هَذِهِ الْآيَةَ- يا أَيُّهَا الَّذِينَ‌ آمَنُوا اذْكُرُوا اللَّهَ ذِكْراً كَثِيراً وَ سَبِّحُوهُ بُكْرَةً وَ أَصِيلًا فَقَالَ لَمْ يَجْعَلِ اللَّهُ عَزَّ وَ جَلَّ لَهُ حَدّاً يَنْتَهِي إِلَيْهِ قَالَ وَ كَانَ أَبِي ع كَثِيرَ الذِّكْرِ لَقَدْ كُنْتُ أَمْشِي مَعَهُ وَ إِنَّهُ لَيَذْكُرُ اللَّهَ وَ آكُلُ مَعَهُ الطَّعَامَ وَ إِنَّهُ لَيَذْكُرُ اللَّهَ وَ لَقَدْ كَانَ يُحَدِّثُ الْقَوْمَ وَ مَا يَشْغَلُهُ ذَلِكَ عَنْ ذِكْرِ اللَّهِ وَ كُنْتُ أَرَى لِسَانَهُ لَازِقاً بِحَنَكِهِ يَقُولُ لَا إِلَهَ إِلَّا اللَّهُ وَ كَانَ يَجْمَعُنَا فَيَأْمُرُنَا بِالذِّكْرِ حَتَّى تَطْلُعَ الشَّمْسُ وَ يَأْمُرُ بِالْقِرَاءَةِ مَنْ كَانَ يَقْرَأُ مِنَّا وَ مَنْ كَانَ لَا يَقْرَأُ مِنَّا أَمَرَهُ بِالذِّكْرِ وَ الْبَيْتُ الَّذِي يُقْرَأُ فِيهِ الْقُرْآنُ وَ يُذْكَرُ اللَّهُ عَزَّ وَ جَلَّ فِيهِ تَكْثُرُ بَرَكَتُهُ وَ تَحْضُرُهُ الْمَلَائِكَةُ وَ تَهْجُرُهُ الشَّيَاطِينُ وَ يُضِي‌ءُ لِأَهْلِ السَّمَاءِ كَمَا يُضِي‌ءُ الْكَوْكَبُ الدُّرِّيُّ لِأَهْلِ الْأَرْضِ وَ الْبَيْتُ الَّذِي لَا يُقْرَأُ فِيهِ الْقُرْآنُ وَ لَا يُذْكَرُ اللَّهُ فِيهِ تَقِلُّ بَرَكَتُهُ وَ تَهْجُرُهُ الْمَلَائِكَةُ وَ تَحْضُرُهُ الشَّيَاطِينُ وَ قَدْ قَالَ رَسُولُ اللَّهِ ص أَ لَا أُخْبِرُكُمْ بِخَيْرِ أَعْمَالِكُمْ لَكُمْ أَرْفَعِهَا فِي دَرَجَاتِكُمْ وَ أَزْكَاهَا عِنْدَ مَلِيكِكُمْ وَ خَيْرٍ لَكُمْ مِنَ الدِّينَارِ وَ الدِّرْهَمِ وَ خَيْرٍ لَكُمْ مِنْ أَنْ تَلْقَوْا عَدُوَّكُمْ فَتَقْتُلُوهُمْ وَ يَقْتُلُوكُمْ فَقَالُوا بَلَى فَقَالَ ذِكْرُ اللَّهِ عَزَّ وَ جَلَّ كَثِيراً ثُمَّ قَالَ جَاءَ رَجُلٌ إِلَى النَّبِيِّ ص فَقَالَ مَنْ خَيْرُ أَهْلِ الْمَسْجِدِ فَقَالَ أَكْثَرُهُمْ لِلَّهِ ذِكْراً وَ قَالَ- رَسُولُ اللَّهِ ص مَنْ أُعْطِيَ لِسَاناً ذَاكِراً فَقَدْ أُعْطِيَ خَيْرَ الدُّنْيَا وَ الْآخِرَةِ وَ قَالَ فِي قَوْلِهِ تَعَالَى- وَ لا تَمْنُنْ تَسْتَكْثِرُ قَالَ لَا تَسْتَكْثِرْ مَا عَمِلْتَ مِنْ خَيْرٍ لِلَّهِ.

1. A number of our people have narrated from Sahl ibn Ziyad from Ja’far ibn Muhammad al-Ash’ari from ibn al-Qaddah from Abu ‘Abdillah (a.s.) who has said the following: “Everything has a limit where it ends except speaking of Allah which has no limit to end. Allah, the Most Majestic, the Most Holy, has sanctioned obligations. When one fulfills them, their limit is where they end. The limit for the month of Ramadan is that when one fasts that is its limit where it ends, and the limit of Hajj is that when one performs Hajj it ends. Al-Dikr (speaking of Allah) is as such that Allah, the Most Majestic, the Most Holy, does not agree with a very little of it and He has not set a limit for where it ends.’ The Imam then read this verse of the Holy Quran: ‘Believers, remember Allah very often (33:41) and glorify Him both in the mornings and in the evenings.’ (33:42) “The Imam said, ‘Allah, the Most Majestic, the Most Holy, has not set a limit for it where it would end.’ He them said, ‘My father would speak of Allah very often. I would walk with him and he would speak of Allah. At the time I ate food with him he would speak of Allah. Even when speaking to people it would not stop him from speaking of Allah. I could see his tongue move saying, ‘No one deserves to be worshipped except Allah.’ He would gather all of us together and order us to speak of Allah until sunrise. He would command those of us who could read, to read the Holy Quran and those who could not to speak of Allah. The house in which the Holy Quran is read and Allah, the Most Majestic, the Most Holy, is spoken of therein blessings increase and angels are present, the devils run away and it shines to the people of heavens just as a diamond (shaped) star shines for the people of earth. The house in which the Holy Quran is not read, Allah is not spoken of therein, blessings in it decrease, angels move away from it and devils turn to be present therein. The Messenger of Allah once asked, ‘Should I tell you about the best of your deeds, which raise your position the highest and the purest before your owner, much better for you than the world and its money and is better for you than your fighting against your enemies whom you would eliminate or else they would kill you?’ They said, ‘Yes.’ He then said, ‘Speak of Allah, the Most Majestic, the Most Holy, very often.’ “The Imam then said, ‘Once a man came to the Holy Prophet and said, “Who is the best of the people in this Mosque?” He said, ‘The one who speaks of Allah more than others.’ The Messenger of Allah has said, ‘Whoever is given a tongue that speaks of Allah very often has been granted the good for both this and the next life.’ “About the words of Allah, ‘. . . and do not think that by doing such deeds, you have done a great favor to Allah,’ (74:6) the Imam said, ‘It means do not think what you have done for the sake of Allah is a great deal.’”

سَأَلْتُ أَبَا الْحَسَنِ مُوسَى بْنَ جَعْفَرٍ ع قُلْتُ أَشْتَرِي الْجَارِيَةَ فَتَمْكُثُ عِنْدِي الْأَشْهُرَ لَا تَطْمَثُ وَ لَيْسَ ذَلِكَ مِنْ كِبَرٍ وَ أُرِيهَا النِّسَاءَ فَيَقُلْنَ لِي لَيْسَ بِهَا حَبَلٌ فَلِي أَنْ أَنْكِحَهَا فِي فَرْجِهَا فَقَالَ إِنَّ الطَّمْثَ قَدْ تَحْبِسُهُ الرِّيحُ مِنْ غَيْرِ حَبَلٍ فَلَا بَأْسَ أَنْ تَمَسَّهَا فِي الْفَرْجِ قُلْتُ فَإِنْ كَانَ بِهَا حَبَلٌ فَمَا لِي مِنْهَا قَالَ إِنْ أَرَدْتَ فِيمَا دُونَ الْفَرْجِ.

1. A number of our people have narrated from Ahmad ibn Muhammad from ibn Mahbub from Rifa‘ah ibn Musa al-Nakhkhas who has said the following: “I once asked Musa ibn Ja‘far (a.s.), about the case of a slave-girl I purchased. She lives with me for several months without experiencing Hayd (menses) but not because of old age. Other women examine her and tell me that she is not pregnant. Can I have intercourse with her? He (the Imam) said, ‘Hayd (menses) is sometimes blocked by air without pregnancy. It is not harmful if you touch her vagina? I then asked if she is pregnant what then? He (the Imam) said, ‘If you like you can benefit from other than vagina?”

A number of our people have narrated from Ahmad ibn Muhammad ibn ‘Isa from al-Hassan fbn Mahbub from ‘Abd Allah ibn Sinan who has said the following: “This is about a man who knowingly eats without good reason in the month of Ramadan one day. Abu ‘Abd Allah (a.s.), has said, ‘He for one day (of destroying his fast) is required to either set free a slave, fast for two consecutive months, or feed sixty destitute people. If he cannot do any of the above, he must give charity of whatever amount he is able to do.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from ibn Sinan who has narrated the following: “I once asked abu ‘Abd Allah (a.s.), about the case of a man who leaves behind his brother from his mother. He (the Imam) said, ‘If he has not left other heirs besides him the legacy belongs to him.’ I then asked about a brother from a mother with a grandfather. He (the Imam) said, ‘One-sixth must be given to the brother from his mother and the rest is given to the grandfather.’ I then asked about a brother from the father and a grandfather. He (the Imam) said, ‘The legacy between them is in equal shares.’”

2. Muhammad ibn Yahya has narrated from ‘Abdallah ibn Muhammad from Ali ibn al-Hakam from Aban ibn ‘Uthman from ’Abdallah ibn Abu Ya‘fur and al-Husayn ibn al-'Ala' who was also present at the gathering with Ibn Abi Ya‘fur (Abu Ya'fur narrates the following): "I asked Abu ‘Abdallah (a.s.) about the differences in Hadith which is narrated from people whom we trust and yet from other people we do not trust. The Imam replied, 'If you come across a Hadith and you find evidence in the holy Quran to support it or in the Hadith of the holy Prophet (you may follow it), otherwise, the one who has come to you with it is more deserving of it.'"

قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع أَشْتَرِي الْجَارِيَةَ فَرُبَّمَا احْتَبَسَ طَمْثُهَا مِنْ فَسَادِ دَمٍ أَوْ رِيحٍ فِي الرَّحِمِ فَتُسْقَى الدَّوَاءَ لِذَلِكَ فَتَطْمَثُ مِنْ يَوْمِهَا أَ فَيَجُوزُ لِي ذَلِكَ وَ أَنَا لَا أَدْرِي ذَلِكَ مِنْ حَبَلٍ هُوَ أَوْ مِنْ غَيْرِهِ فَقَالَ لِي لَا تَفْعَلْ ذَلِكَ فَقُلْتُ لَهُ إِنَّهُ إِنَّمَا ارْتَفَعَ طَمْثُهَا مِنْهَا شَهْراً وَ لَوْ كَانَ ذَلِكَ مِنْ حَبَلٍ إِنَّمَا كَانَ نُطْفَةً كَنُطْفَةِ الرَّجُلِ الَّذِي يَعْزِلُ فَقَالَ لِي إِنَّ النُّطْفَةَ إِذَا وَقَعَتْ فِي الرَّحِمِ تَصِيرُ إِلَى عَلَقَةٍ ثُمَّ إِلَى مُضْغَةٍ ثُمَّ إِلَى مَا شَاءَ اللَّهُ وَ إِنَّ النُّطْفَةَ إِذَا وَقَعَتْ فِي غَيْرِ الرَّحِمِ لَمْ يُخْلَقْ مِنْهَا شَيْ‌ءٌ فَلَا تَسْقِهَا دَوَاءً إِذَا ارْتَفَعَ طَمْثُهَا شَهْراً وَ جَازَ وَقْتُهَا الَّذِي كَانَتْ تَطْمَثُ فِيهِ‌.

2. Ibn Mahbub has narrated from Rifa’ah who has said the following: “I once said to abu ‘Abd Allah (a.s.), that I may purchase a slave-girl. Her Hayd (menses) stops because of spoiled blood or some kind of air in her womb, and she uses medicine for cure and her Hayd (menses) begins on the same day. I do not know if it is because of pregnancy or for other reasons, is it (use of medicine) permissible? He (the Imam) said, ‘You must not (allow to) do so? I then said that her Hayd (menses) has stopped for a month. Were it because of pregnancy, it would be a seed like the seed of man for which he may use contraceptives. He (the Imam) said, ‘If the seed falls inside the womb, it changes into a lump, then into flesh, then into what Allah wills. If the seed (semen) falls in places other than the womb nothing is created thereof. You must not give her medicine, when her Hayd (menses) stops, for a month and her time of Hayd (menses) passes?” (Fatwa best explains the above Hadith; it deals with several issues such as contraceptives, liability for abortion and the stages of fetuses.)

Ali ibn Ibrahim has narrated from his father from and Muhammad ibn ‘Isma‘il has narrated from al-Fadl ibn Shadhan from all from Ibn Abi ‘Umayr from Jamil ibn Darraj who has said the following: “I once asked abu ‘Abd Allah (a.s.), about a man who purposely destroys one day of the fast of the month of Ramadan. He (the Imam) said, ‘Once a man came to the Holy prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, and said, “O Messenger of Allah!” He (the Messenger of Allah) replied, “What is the matter with you?” He replied, “I fell on my wife.” He (the Messenger of Allah) said, “Give charity and repent.” He (the man) said, “I swear by the One who has made your right great, there is nothing in my house small and very little or large and a great deal.” He (the Imam) said that a man then came with a massive bushel of dates which was twenty Sa‘, each of which was equal to ten of our Sa‘. The Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, said to him (the man), “Take this and give it as charity.” He (the man) said, “O Messenger of Allah, to whom should I give this charity when I have told you that in my house there is nothing little or a great deal.” He (the Messenger of Allah) said, “Take it and feed your family and ask Allah for forgiveness.’” He (the narrator) has said that when we came out (of the meeting) our people told us that expiation is to set free a slave saying, ‘Set free a slave, fast or give charity.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from Ali ibn al-Hakam from Sayf ibn ‘Amirah from Bakr ibn Bukayr from Zurara ibn ‘A’Yun from Abu ‘Abdillah (a.s.) who has said the following: “Tasbih of Fatimah al-Zahra (a.s.) is a form of ‘Often speaking and remembering Allah’ about which Allah, the Most Majestic, the Most Holy, has said, ‘Believers, remember Allah very often (33:41) and glorify Him both in the mornings and in the evenings.’” (33:42) It is narrated from him (narrator of the Hadith above) from Ali ibn al-Hakam from Sayf ibn ‘Amirah from abu ‘Usamah Zayd al-Shahham and Mansur ibn Hazim and Sa’id al-‘A’raj from Abu ‘Abdillah (a.s.) a similar Hadith.

A group of our companions narrated from Aḥmad ibn Muḥammad, from Ibn Maḥbūb, from Hishām ibn Sālim, from Burayd al-ʿIjlī, who said: Abū Jaʿfar (AS) was asked about a man upon whom witnesses testified that he had broken his fast during the month of Ramadan for three days. He said, "He is to be asked: 'Do you believe that there is any sin upon you for breaking your fast during the month of Ramadan?' If he says 'No,' then it is upon the Imam to kill him. If he says 'Yes,' then it is upon the Imam to punish him severely with beating."

A number of our people has narrated from Ahmad ibn Muhammad ibn Khalid from ‘Isma’il ibn Mihran from abu Sa‘id al-Qammat and Salih ibn Sa‘id from Aban ibn Taghlib who has said the following. “A man asked a question from Imam abu Ja‘far (a.s.) who replied to it and then the man said, “The Fuqaha, scholars of law, do not say this.” The Imam then said, “It is a pity. Have you ever seen a Faqih, a scholar of law? The real Faqih, scholar of law is one who maintains restraint from the worldly matters, who is deeply interested in the life hereafter and holds firmly to the Sunnah, noble tradition of the holy prophet (s.a.)”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad and Ali ibn Ibrahim has narrated from his father from ibn Mahbub from abu Ayyub al-Khazzaz from Yazid al-Kunasiy who has said the following: “I once asked abu Ja‘far (a.s.), about the divorce of a pregnant woman. He (the Imam) said, ‘She is divorced once for waiting period by months and in the presence of witnesses.’ I then asked, ‘Can he go back to her?’ He (the Imam) said, ‘Yes, she is his wife.’ (I then asked,) ‘What happens if he revokes the divorce, then decides to divorce once more?’ He (the Imam) said, ‘He cannot divorce until a month passes after he has touched her.’ I then asked, ’What happens if he divorces for the second time and arranges for witness about his revoking the divorce and touches her? Then he divorces for the third time in the presence of witnesses for waiting period of every month; if she becomes stranger like the woman who is divorced with waiting period because of which she is not lawful for her husband until she marries another man?’ He (the Imam) said, ‘Yes, it can happen.’ I then asked, ‘What is her waiting period?’ He (the Imam) said, ‘Her waiting period is giving birth to what is in her womb; then she becomes lawful for whoever wants to marry her.’”

[1]يعني أنّه لا يجوز أن يطلقها للعدة الا تطليقة واحدة فان بدا له أن يطلقها ثانية بعد ما بدا له في المراجعة فلا بأس فانها أيضا واحدة أما إذا كان غرضه اولا من الطلاق أن يراجعها ثمّ يطلقها ثمّ يراجعها بعد الأولى فعليه أن يصبر حتّى تضع ما في بطنها ثمّ إن تزوجها بعد طلاقها ثانية فيكون طلاقه للسنة لا للعدة. قوله:« بالشهور» يعنى كلما طلقها للعدة بعد التطليقة الأولى فلا بدّ من مضى شهر من مسها كما فسره بعد و هذا الذي قلناه في تفسير الواحدة مصرح في اخبار هذا الباب.( فى)ص 82

[1]قال الشيخ في التهذيبين: هذا الخبر نحمله على من يكون مثلها تحيض لان اللّه تعالى شرط ذلك و قيده بمن يرتاب بحالها قال اللّه تعالى:« وَ اللَّائِي يَئِسْنَ مِنَ الْمَحِيضِ مِنْ نِسائِكُمْ إِنِ ارْتَبْتُمْ فَعِدَّتُهُنَّ ثَلاثَةُ أَشْهُرٍ» و هذا أولى ممّا قاله ابن سماعة لانه قال تجب العدة على هؤلاء كلهن و انما سقط عن الإماء و العدة لان هذا تخصيص منه في الإماء من غير دليل و الذي ذكرناه مذهب معاوية بن حكيم من متقدمى فقهاء أصحابنا و جميع فقهاء المتأخرين و هو مطابق لظاهر القرآن و قد استوفينا تأويل ما يخالف ما أفتينا به ممّا ورد من الاخبار فيما تقدم انتهى. و قال الفيض- رحمه اللّه- بعد نقل هذا الكلام: هذا التحقيق و التوفيق ينافى ما مر من الاخبار من رواية محمّد بن حكيم أن المرأة التي لا تحيض مثلها و لم تحض تعتد بثلاثة أشهر فان ارتابت بالحمل تعتد بتسعة أشهر الا أن يقال ان لفظة« لا» فى لا تحيض مثلها من زيادة النسّاخ انتهى.ص 83

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع- عَنْ رَجُلٍ مَاتَ وَ تَرَكَ إِخْوَةً وَ أَخَوَاتٍ لِأُمٍّ وَ جَدّاً قَالَ فَقَالَ الْجَدُّ بِمَنْزِلَةِ الْأَخِ مِنَ الْأَبِ لَهُ الثُّلُثَانِ وَ لِلْإِخْوَةِ وَ الْأَخَوَاتِ مِنَ الْأُمِّ الثُّلُثُ فَهُمْ فِيهِ شُرَكَاءُ سَوَاءً.

It is narrated from the narrator of the previous Hadith from Ahmad ibn Muhammad from and Ali ibn Ibrahim has narrated from his father from ibn Mahbub from Husayn ibn ‘Umarah from Misma‘ abu Sayyar who has narrated the following: “I once asked abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who dies and leaves behind brothers and sisters from his mother and a grandfather. He (the Imam) said, ‘The grandfather is like a brother from the father. He receives two-thirds and brothers and sisters from one’s mother receive one-third who distribute it among themselves in equal shares.’”
