عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ وَ الْحُسَيْنُ بْنُ مُحَمَّدٍ عَنْ أَحْمَدَ بْنِ إِسْحَاقَ جَمِيعاً عَنْ بَكْرِ بْنِ مُحَمَّدٍ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ:

مَنْ قَالَ حِينَ يَأْخُذُ مَضْجَعَهُ ثَلَاثَ مَرَّاتٍ الْحَمْدُ لِلَّهِ الَّذِي عَلَا فَقَهَرَ وَ الْحَمْدُ لِلَّهِ الَّذِي بَطَنَ فَخَبَرَ وَ الْحَمْدُ لِلَّهِ الَّذِي مَلَكَ فَقَدَرَ وَ الْحَمْدُ لِلَّهِ الَّذِي‌ يُحْيِ الْمَوْتى‌* وَ يُمِيتُ الْأَحْيَاءَ وَ هُوَ عَلى‌ كُلِّ شَيْ‌ءٍ قَدِيرٌ* خَرَجَ مِنَ الذُّنُوبِ كَهَيْئَةِ يَوْمَ وَلَدَتْهُ أُمُّهُ.

1. Ali ibn Ibrahim has narrated from his father and Al-Husayn ibn Muhammad have narrated from Ahmad ibn Ishaq all from Bakr ibn Muhammad from Abu ‘Abdillah (a.s.) who has said the following: “Whoever at the time of going to bed says three times, ‘All praise belongs to Allah, Who is High, thus, He is Dominant. All praise belongs to Allah, Who is hidden, thus, He knows. All praise belongs to Allah, Who owns, thus. He has measured (all things), all praise belongs to Allah, Who gives life to the dead, and causes the living to die, and He has power over all things,’ he will come out of sins just like the day he was born from his mother.’”

1. Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hammad from al-Halabiy who has said the following: “I once asked abu ‘ Abd Allah (a.s.), about a man who fasts on journey. He (the Imam) said, ‘If he is informed that the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, prohibited fasting on a journey, he is required to complete its Qada’ (compensatory fast) but if such information has not reached him, he is not obligated for anything/”

Al-Husayn ibn Muhammad has narrated from Mu’alla’ ibn Muhammad and Ali ibn Muhammad al-Qashaniy from Salih ibn abu Hammad all from al-Washsha’ from Ahmad ibn ‘ A’idh from abu Khadijah, who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘In the beginning of time when people found something and took it this (act) caused them to lose the ability to move even one step until they threw away what they had found. The rightful owner then came to pick it up. People became daring to greater wrong acts but it will in a certain time come back again.”’

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from ibn Bukayr from ‘Ubayd ibn Zurarah who has said the following: “I once asked abu ‘ Abd Allah (a.s.), about the case of a man who is ill; if he can divorce his wife in such condition. He (the Imam) said, ‘No, he cannot divorce, however, he can marry if he wants and if he goes to bed with her, she inherits his legacy but if he did not go to bed with her his marriage is invalid.’”

[1]قال في المسالك: طلاق المريض كطلاق الصحيح في الوقوع و لكنه يزيد عنه بكراهته مطلقا و ظاهر بعض الأخبار عدم الجواز و حمل على الكراهة جمعا ثمّ إن كان الطلاق رجعيا توارثا ما دامت في العدة إجماعا و إن كان بائنا لم يرثها الزوج مطلقا كالصحيح و ترثه هي في العدة و بعدها الى سنة من الطلاق ما لم تتزوج بغيره أو يبرأ من مرضه الذي طلق فيه هذا هو المشهور خصوصا بين المتأخرين، و ذهب جماعة منهم الشيخ في النهاية الى ثبوت التوارث بينهما في العدة مطلقا و اختصاص الارث بعدها بالمرأة منه دون العكس إلى المدة المذكورة.( آت)ص 121

Abu Ali a l-Ash ‘ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan ibn Yahya and Muhammad ibn ’Isma‘il has narrated from al-Fadl ibn Shadhan all from Safwan from ibn Muskan from Dawud ibn Farqad who has narrated the following: “Once abu ‘Abd Allah (a.s.), was asked about the case of a newborn who has the reproductive organs of both male and female and about his inheritance. He (the Imam) said, ‘If urine comes from the male organ its inheritance is that which is for a male, and if urine comes from the female organ then her share is like the share of a female/”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad in a marfu’ manner from Abu ‘Abdillah (a.s.) who has said the following: “When any of you is about to go to your bed you should say, ‘O Lord, I have placed my soul in Your custody, keep it secure in a place that You like, and forgive, and if You return it to my body, return it with belief, and with knowledge of the rights of Your friends until it will die upon such belief.’”

Through the same chain of narrators as that of the previous Hadith the following is narrated from ibn Mahbub from Rabi’ al-Asamm from abu ‘ Ubaydah al-Hadhdha’ and Malik ibn ‘ Atiyyah from abu al-Ward who both have said the following: “About the case of a man who divorces his wife once during his illness and waits until her waiting period ends she inherits him as long as she does not marry; but if she marries after her waiting period she then does not inherit his legacy.’”

O Lord, protect me in my sleep and when I am awake.’”

A number of our people have narrated from Sahl ibn Ziyad and Ahmad ibn Muhammad from all from ibn Mahbub from Jamil ibn Salih who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), about the case of a man who has found a dinar in his house. He (the Imam) asked, ‘Does anyone else enter his house?’ I (the narrator) replied, ‘Yes, many people enter his house.’ He (the Imam) said, ‘This is a case of lost and found property.’ I (the narrator) then asked about the case of a man who has found a dinar in his box. He (the Imam) asked, ‘Does anyone besides him enter his hand in his box?’ I (the narrator) replied, ‘No, no one else does so.’ He (the Imam) said, ‘It then is for him.’”

Ali ibn Ibrahim has narrated from his father and Muhammad ibn Yahya has narrated from ‘Abd Allah ibn Muhammad all from Ibn Abi ‘Umayr from Hisham ibn Salim who has narrated the following: “I once asked abu ‘Abd Allah (a.s.), about the case of a newborn who has the reproductive organs of both male and female. He (the Imam) said, ‘Such person inherits according to the reproductive organ from which urine comes first. If it comes from both at the same time then it is according to whichever sends with more pressure and if this is also equal then such person inherits the share of both male and female/”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Faddal from ibn Bukayr from certain persons of our people who have narrated the following: “About the case of a newborn who has the reproductive organs of both male and female, one of the two Imam, (abu Ja‘far or abu ‘Abd Allah), ‘Alayhim al-Salam, has said, ‘Such person inherits according to the case of the organ from which the urine comes. If he urinates from the male organ he inherits the share of a male person; if she urinates from the female organ she inherits the share of a female/ This is about a newborn who does not have an organ like male or female. However, has only a hole. One of the two Imam, (abu Ja‘far or abu ‘Abd Allah), ‘Alayhim al-Salam, has said that such person inherits like a male; if it (urine) comes with a dart but if it does not reach far away then that person inherits like a female/”

A number of our people have narrated from Ahmad ibn Muhammad from ‘Abd Allah ibn Muhammad al-Hajjal from Tha’labah ibn Maymun from Sa‘id ibn ‘Amr al-Ju’fiy who has said the following: “I once left for Makkah and my financial condition was the worst among people. I mentioned to abu ‘Abd Allah (a.s.). When I left his meeting at the door I found a bag with seven hundred dinar in it. I immediately returned to the Imam and informed him about it. He (the Imam) said, ‘Sa‘id, be pious before Allah, most Majestic, most Glorious. You must announce your finding in all the places (Mashahid) where people perform the acts of Hajj.’ I had a degree of hope about Imam’s permission for me to use some of that money. I then left and I was sad. I went to Mina and moved far from people, searched around and ended up to the places endowed for the benefit of people. I found a room away from people and then announced, ‘I have found a bag. Whoever has lost it must give proper description and collect it from me.’ As soon as I made the announcement a man stood over my head saying, ‘I am the owner of the bag/ I (the narrator) said to myself I wish you had not said it. I then asked, ‘What is the description of the bag?’ He gave me the exact description and I gave it to him.’ He moved to one side and counted them and found it to be the same amount. He then counted seventy dinars and said, ‘Take this lawful money; it is better than seven hundred unlawful dinars.’ I took them and visited abu ‘Abd Allah (a.s.), and informed him of the story in details. He (the Imam) said, ‘When you complained before me about your condition I ordered to keep aside thirty dinars for you. O girl, bring for him those dinars.’ I took them and was of the best financial condition in my people.’”

It is narrated from the narrator of the previous Hadith from al-Hassan ibn Muhammad from ibn Sama‘ah from ibn Ribat from ibn Muskan from abu al-‘Abbas who has said the following: “I once asked abu ‘Abd Allah (a.s.), about the case of a man who divorces his wife once when he is ill and he had divorced her twice before. He (the Imam) said, ‘She inherits his legacy if it was during his illness.’ I then asked, ‘What is the limit of illness?’ He (the Imam) said, ‘The illness which continues until he dies even if it prolongs for one year.’”

It is narrated from him (narrator of the Hadith above) from Ahmad ibn Muhammad from al-Husayn ibn Sa’Id from Fadalah ibn Ayyub from Dawud ibn Farqad from his brother that Shahab ibn ‘Abd Rabbihi asked him to ask help from abu ‘Abd Allah (a.s.): “Ask the Imam, ‘A woman frightens me in my dream at night.’ The narrator has said that the Imam said, ‘Tell him to take rosary beads ( sabhah ) and say, ‘Allah is greater than can be described, thirty-four times, all praise belongs to Allah, thirty-three times, Allah is free of defects, thirty-three times,’ then say, “No one deserves to be worshipped except Allah, alone Who has no partner, to Him belongs the Kingdom, all praise belongs to Him, He gives life, causes death, causes death and gives life, in His hand is all good, for Him is the changing of the night and the day and He has power over all things, ten times.’”

Muhammad ibn Yahya has narrated from Muhammad ibn Ahmad from Musa ibn ‘Umar from al-Hajjal from Dawud ibn abu Yazid who has said the following: “Once a man said, ‘I have found a certain amount of property and because of it I am afraid for myself. I wish to find the owner to free myself of this difficulty. He (the narrator) has said, that abu ‘Abd Allah (a.s.), asked him, ‘Will you, by Allah, on finding the owner give it to him?’ He replied, ‘Yes, by Allah, I will do so.’ He (the Imam) said, ‘I am the one. By Allah, it has no owner besides me.’ He (the Imam) made him to take an oath to do with what he has found as he (the Imam) commands him to do. He took an oath and he (the Imam) commanded him to distribute it among his brothers, saying, ‘You will be safe from what you are afraid of.’ He has said, ‘I distributed it among my brothers.’” (Consult fatwa about this Hadith)

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Jamil ibn Darraj from abu al-‘Abbas who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘If a man divorces his wife during his illness she inherits his legacy as long as it is in his illness even if her waiting period ends unless he gets well from that illness.’ I then asked, ‘What happens if the illness prolongs?’ He (the Imam) said, ‘It is up to one year.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Mu’awiyah ibn Wahab who has said the following: “One night the son of Abu ‘Abd Allah (a.s.) came to him and said, ‘Father I want to go to sleep.’ He said son, say, ‘1 testify that no one deserves to be worshipped except Allah, that Muhammad (a.s.) is the servant and messenger of Allah. I seek protection with the greatness of Allah. I seek protection with majesty of Allah, I seek protection with the power of Allah, I seek protection with the glory of Allah, I seek protection with the authority of Allah; He has power over all things. I seek protection with the immunity of Allah, I seek protection with the forgiveness of Allah, I seek protection with the mercy of Allah, against the evil of poisonous reptiles and insects, against the evil of small and large animals during the day or night, against the evil of sinful Jinn and human beings, against the evil of the sinful Arab and non-Arab people, against the evil of lightning and cold. O Lord, grant al-Salat (favors) upon Muhammad, Your servant and messenger.’ Mu’awiyah has said that each time the name of the Holy Prophet was mentioned, the boy kept saying “The noble and blessed,” and asked the Imam, ‘Can I say, “The noble and blessed?”’ The Imam said, ‘Yes, son, “The noble and blessed.’”

Ali ibn Ibrahim has narrated from his father from certain persons of our people from abu al-‘Ala’ who has said the following: “This is concerning my question before abu ‘Abd Allah (a.s.), ‘A man found a certain amount of goods and he announced about it in public for one year. He then bought a slave-girl. A man then claiming to be the owner came to him and found the slave-girl who was purchased with that money to be his daughter.’ He (the Imam) said, ‘He is entitled to take the dirhams but not the slave- girl. The money belongs to him but his daughter is the slave-girl of other people.’”

Ali ibn Ibrahim has narrated from his father from certain individuals of his people from Mufaddal ibn ‘Umar who has said the following: “Abu ‘Abd Allah (a.s.) said to me, ‘If you can, do not go to sleep without seeking protection with eleven letters.’ I then asked, ‘What are they?’ The Imam told me to say, ‘I seek protection with the majesty of Allah, I seek protection with the power of Allah, I seek protection with the glory of Allah, I seek protection with the authority of Allah, I seek protection with the beauty of Allah, I seek protection with the defense of Allah, I seek protection with the prevention of Allah, I seek protection with the community of Allah, I seek protection with the possession of Allah, I seek protection with the face of Allah, I seek protection with the Messenger of Allah against the evil of whatever He has created, spread and settled. ’ The Imam said, ‘You may seek protection with these letters whenever you like.’”

Muhammad ibn Yahya has narrated from ‘Abd Allah ibn Ja’far who has said the following: “I once wrote to the man (a.s.), and asked him about the case of a man who had bought camels or cows for sacrificial offering. When he slaughtered, he found a bag of dinar or diamond inside the animal. To whom this found property belong?’ He (the Imam) (a.s.), wrote back to me, ‘He must announce it before the seller and if he did not know about it, then whatever is found is what Allah has granted to him.’”

Muhammad has narrated from Ahmad from al-Husayn ibn Sa‘id from his brother al-Hassan from Zur’ah ibn Muhammad from Sama‘ah who has said the following: “I once asked abu ‘Abd Allah (a.s.), about the case of a man who divorces his wife when he is ill. He (the Imam) said that she inherits his legacy. She inherits him as long as she is in her waiting period. If he has divorced her in a condition that harms her, she inherits him up to one year; and if it is more than one year even by one day, then she does not inherit and she counts a waiting period for four months and ten days like the waiting period for a widow.’”

11. Ali ibn Ibrahim has narrated from his father from Hammad ibn Hariz from Muhammad ibn Muslim who has said the following: “I asked abu Ja’far (a.s.), about lost property found. He (the Imam) said, ’He must not pick it up, and if he did so, it becomes his responsibility to announce for it up to one year. If the owner did not come forward, it then becomes subject to what his other properties are until someone searching for it comes forward; and if no one came forward he must make a will about it.’”

Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa from Hariz from Zurara from abu Ja’far (a.s.) who has said the following: “During the night if you wake up say, ‘All praise belongs to Allah, who has returned my spirit to me so I can thank Him and worship Him.’ When you hear the voice of a rooster then say, ‘O the Faultless, the Holy, Lord of the angels and the Spirit, Your mercy comes before Your anger and no one deserves to be worshipped except You alone. 1 have committed evil deeds and has wronged myself, please forgive me. No one can forgive sins except You.’ When you stand up look to the horizons and say, ‘O Lord, the dark night is not hidden from You nor is the skies with constellations or the well-stretched earth, or the darknesses one over the other, or the wavy seas or the traveler at night of Your creatures; You know the secret glances of the eyes and what the chests hide. The stars have disappeared, the eyes have gone to sleep and You are the Living the Guardian, slumber cannot overtake You nor sleep. My Lord is free of defects, the Lord of the worlds, and the Holy Being of the messengers; all praise belongs to Allah, Lord of the worlds.’”

Ali ibn Ibrahim has narrated from his father from Ibn Abi ‘Umayr from Hisham ibn Salim , who has said the following: “Abu ‘Abd Allah (a.s.), has said that once someone came to the Holy Prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, saying, ‘I have found a sheep.’ The Messenger of Allah said, ‘It is for you or your brother or a wolf.’ He then said, T have found a camel.’ The Messenger of Allah asked, ’Does it have its shoes and water container? Nevertheless, take notice, its shoes are its feet and its water container is its hump. You must not bother the camel.’” (Consult fatwa also.)

If he marries and goes to bed with her, it is permissible; and if he did not go to bed with her until he dies from that illness, his marriage is invalid and she does not have mahr (dower) or inheritance.’”

A number of our people have narrated from Ahmad ibn Muhammad from and Sahl ibn Ziyad from ibn Mahbub from ‘ Abd Allah ibn Sinan who has said the following: “Abu ‘Abd Allah (a.s.), has said, ‘If one finds a certain amount of goods, or a camel in wilderness which has become tired has stopped walking and its owner has abandoned it; someone other than the owner then takes it, tends to it and incurs expenses to revive it from tiredness and death; it then is for him. He (the owner) has no reason to claim it. It then is like a lawful thing for him (the finder).”’

Muhammad ibn Yahya has narrated from ‘Abd Allah ibn Muhammad from his father from ‘Abd Allah ibn Mughirah from al-Sakuniy who has said the following: “Abu ‘Abd Allah (a.s.), has said that Amir al-Mu’minin (a.s.), issued a judgment about the animal of a man who had abandoned it as follows: ‘If he has left it near water, and proper and safe pasture it is for him. He takes it wherever he finds it. If he has left it in an unsafe place, without water and pasture, it then is for the one who finds it.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from Muhammad ibn Khalid and al-Husayn ibn Sa’Id all from al-Nadr ibn Suwayd from Yahya al-Halabi from abu ‘Usamah who has said the following: “I heard Abu ‘Abdillah (a.s.) saying, ‘Whoever recites Chapter 112 of the Holy Quran one hundred times at the time of going to sleep his deeds of the past fifty years will be forgiven.’ Yahya has said that I asked Sama’a about it and he said that abu Basir narrated to him saying, ‘I heard Abu ‘Abdillah (a.s.) saying the same thing and said to me, “O abu Muhammad, if you try it you will find it firmly established.’””

16. A number of our people have narrated from Sahl ibn Ziyad from Muhammad ibn al-Hassan al-Shammun from al-Asamm from Misma’ who has said the following: “Abu ‘Abd Allah (a.s.), has said that Amir al-Mu’minin (a.s.), has said, ‘If a horse is released by its owner or if he is not able to feed it or pay its expenses, it then is for one who revives it.’ He (the Imam) has said, ‘Amir al-Mu’minin (a.s.), issued a judgment about the case of a man who had left his horse in an unsafe place. The judgment said, “If he has left it in a safe place with water and pasture, it is for him whenever he wants; but if he has left it in an unsafe place without water and pasture then it is for the one who has revived it.’””

Sahl ibn Ziyad has narrated from ibn Mahbub from Safwan al-Jammal who has said the following: “I heard abu ‘Abd Allah (a.s.), saying, ‘One who finds a lost animal but does not announce in public what he has found and then it is found by the owner, it then is for the care-taker (owner) or its kind (current value) from the assets of the one who has kept it in hiding.’”

Ali ibn Ibrahim has narrated from his father from al-Nawfali from al-Sakuni from Abu ‘Abdillah (a.s.) who has said the following: “The Holy Prophet has said, ‘Whoever likes to wake up at night, at the time of going to sleep should say, “(In the name of Allah) O Lord, do not allow me to ignore Your anger, do not allow me to forget speaking of You, do not make me of the careless ones, so I will wake up at such and such hour,” Allah, the Most Majestic, the Most Holy, will assign an angel to wake him up at that time.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from Muhammad ibn Khalid and al-Husayn ibn Sa’Id all from al-Qasim ibn ‘Urwah from Hisham ibn Salim from abu ‘Abd Allah (a.s.) who has said the following: “ Tasbih of Fatimah al-Zahra’ (a.s.) should be said when you are about to go to your bed. It is saying, ‘Allah is greater than can be described, thirty-four times, all praise belongs to Allah, thirty-three times and Allah is free of defects,’ thirty-three times. Recite verse 255 of Chapter two, Chapters 113, 114, ten verses from the beginning of Chapter 37 and ten verses from the end of Chapter 37.’”

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from al-Husayn ibn Sa’Id from al-Nadr ibn Suwayd from al-Qasim ibn Sulayman from Jarrah al-Mada’Ini from abu ‘Abd Allah (a.s.) who has said the following: “When one of you wakes up during the night and says, ‘Allah is free of defects, the Lord of the prophets, the Holy Being of the Messengers and the Lord of the suppressed people (‘ A’immah from the family of the Holy Prophet) all praise belongs to Allah, Who gives life to the dead and He has power over all things,’ Allah, the Most Majestic, the Most Holy, will say, “My servant has spoken the truth and has thanked Me.’”

A number of our people have narrated from Sahl ibn Ziyad and Ahmad ibn Muhammad all from Ja’far ibn Muhammad al-Ash’ari from ibn al-Qaddah from abu ‘Abd Allah (a.s.) who has said the following: “When the Messenger of Allah were about to go to his bed he would say, ‘O Lord, in Your name I live and in Your name I will die,’ and when he would wake up he would say, ‘All praise belongs to Allah, Who has given me life after causing me to die and before Him is the resurrection.’ Abu ‘Abd Allah (a.s.) has said, ‘Whoever recites verse 255 of Chapter two before going to sleep three times, verses 18,19 of Chapter three, verse 54 of Chapter 7 and verses 53-54 of Chapter 41 two devils will be assigned to protect him against the rebellious devils whether they like or dislike it, and with them from Allah there will be thirty angels who praise Allah, the Most Majestic, the Most Holy, glorify Him, testify that no one deserves to be worshipped except Allah, say that Allah is greater than can be described, plead before Allah for forgiveness for him until that servant (of Allah) wakes up and he will receive all the reward for it (whatever the angels have said).”’

Ali ibn Ibrahim has narrated from his father from Hammad from Hariz who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘There is no offense in picking up a stick, pieces of wood used in the saddle of camels, stage, ropes, and harnesses and similar items. He (the Imam) then said, ‘Abu Ja’far, ‘Alayhi al-Salam, has said, “Such things are not wanted items.’”” (Consult fatwa also.)
