قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع امْرَأَةٌ وَلَدَتْ مِنَ الزِّنَا أَتَّخِذُهَا ظِئْراً قَالَ لَا تَسْتَرْضِعْهَا وَ لَا ابْنَتَهَا.

سَأَلْتُهُ عَنِ امْرَأَةٍ وَلَدَتْ مِنْ زِنًى هَلْ يَصْلُحُ أَنْ يُسْتَرْضَعَ بِلَبَنِهَا قَالَ لَا يَصْلُحُ وَ لَا لَبَنِ ابْنَتِهَا الَّتِي وُلِدَتْ مِنَ الزِّنَى.
“I once asked abu al-Hassan (a.s.), about the case of a woman who has given birth because of fornication; if it is proper to hire her for breastfeeding. He (the Imam) said, ‘It is not proper as well as the milk of her daughter who is born out of wedlock.’”
يُجْلَدُ حَدَّ الْقَاذِفِ[3] وَ لَا يُفَرَّقُ بَيْنَهُ وَ بَيْنَ امْرَأَتِهِ.

سُئِلَ أَبُو عَبْدِ اللَّهِ ع عَنْ رَجُلٍ قَذَفَ امْرَأَتَهُ بِالزِّنَى وَ هِيَ خَرْسَاءُ صَمَّاءُ لَا تَسْمَعُ مَا قَالَ قَالَ إِنْ كَانَ لَهَا بَيِّنَةٌ فَشَهِدُوا عِنْدَ الْإِمَامِ جُلِدَ الْحَدَّ وَ فُرِّقَ بَيْنَهُمَا ثُمَّ لَا تَحِلُّ لَهُ أَبَداً وَ إِنْ لَمْ تَكُنْ بَيِّنَةٌ فَهِيَ حَرَامٌ عَلَيْهِ مَا أَقَامَ مَعَهَا وَ لَا إِثْمَ عَلَيْهَا مِنْهُ[2].
“Once abu ‘Abd Allah, Alayhi al-Salam, was asked about the case of a man who accuses his wife of committing fornication and she is speechless, deaf and cannot hear. أَقْبَلَ أَبُو جَعْفَرٍ ع فِي الْمَسْجِدِ الْحَرَامِ فَنَظَرَ إِلَيْهِ قَوْمٌ مِنْ قُرَيْشٍ فَقَالُوا مَنْ هَذَا فَقِيلَ لَهُمْ إِمَامُ أَهْلِ الْعِرَاقِ فَقَالَ بَعْضُهُمْ لَوْ بَعَثْتُمْ إِلَيْهِ بِبَعْضِكُمْ يَسْأَلُهُ فَأَتَاهُ شَابٌّ مِنْهُمْ فَقَالَ لَهُ يَا ابْنَ عَمِّ مَا أَكْبَرُ الْكَبَائِرِ قَالَ شُرْبُ الْخَمْرِ فَأَتَاهُمْ فَأَخْبَرَهُمْ فَقَالُوا لَهُ عُدْ إِلَيْهِ فَعَادَ إِلَيْهِ فَقَالَ لَهُ أَ لَمْ

They asked, ‘Who is he?’ It was said to them, ‘He is the Imam of the people of Iraq.’ Certain ones among them said, ‘You may send someone to ask him questions.’ One young man from among them went and asked, ‘Son of my uncle,
مَنْ ضُرِبَ فِي بَيْتِهِ بَرْبَطٌ أَرْبَعِينَ يَوْماً سَلَّطَ اللَّهُ عَلَيْهِ شَيْطَاناً يُقَالُ لَهُ الْقَفَنْدَرُ فَلَا يُبْقِي عُضْواً مِنْ أَعْضَائِهِ إِلَّا قَعَدَ عَلَيْهِ فَإِذَا كَانَ كَذَلِكَ نُزِعَ مِنْهُ الْحَيَاءُ وَ لَمْ يُبَالِ مَا قَالَ وَ لَا مَا قِيلَ فِيهِ.
“He (the Imam) (a.s.), has said, ‘If barbat is played in one’s house for forty days Allah gives its control to a Satan called al-Qafandar who sits on every part of the body of the owner of the house. When this happens bashfulness (the sense to feel ashamed of one’s indecent acts) is taken away from him and he does not
دَخَلَ عَلَيْهِ بَعْضُ أَصْحَابِهِ فَرَأَى عَلَيْهِ قَمِيصاً فِيهِ قَبٌّ قَدْ رَقَعَهُ[1] فَجَعَلَ يَنْظُرُ إِلَيْهِ فَقَالَ لَهُ أَبُو عَبْدِ اللَّهِ ع مَا لَكَ تَنْظُرُ فَقَالَ قَبٌّ مُلْقًى فِي قَمِيصِكَ قَالَ فَقَالَ لِيَ اضْرِبْ يَدَكَ إِلَى هَذَا الْكِتَابِ فَاقْرَأْ مَا فِيهِ وَ كَانَ بَيْنَ يَدَيْهِ كِتَابٌ أَوْ قَرِيبٌ مِنْهُ فَنَظَرَ الرَّجُلُ فِيهِ فَإِذَا فِيهِ لَا إِيمَانَ لِمَنْ لَا حَيَاءَ لَهُ وَ لَا
“Once certain person of his people came to him (the Imam) and he saw on him (the Imam) a shirt with a patch stitched on it and he kept looking at it. Abu ‘Abd Allah (a.s.), said, ‘What is the matter; what are you looking at?’ He replied, ‘I look at the patch stitched on your shirt.’ He (the Imam) said, ‘Pick up this bo
قَالَ أَمِيرُ الْمُؤْمِنِينَ ص إِذَا ظَهَرَتِ الْقَلَانِسُ الْمُتَرِّكَةُ ظَهَرَ الزِّنَا[2].

كَتَبَ بَعْضُ أَصْحَابِنَا كِتَاباً إِلَى أَبِي جَعْفَرٍ الثَّانِي ع مَعِي يَسْأَلُهُ عَنْ رَجُلٍ فَجَرَ بِامْرَأَةٍ ثُمَّ إِنَّهُ تَزَوَّجَهَا بَعْدَ الْحَمْلِ فَجَاءَتْ بِوَلَدٍ وَ هُوَ أَشْبَهُ خَلْقِ اللَّهِ بِهِ فَكَتَبَ بِخَطِّهِ وَ خَاتَمِهِ الْوَلَدُ لِغَيَّةٍ لَا يُورَثُ[1].
“Once certain persons of our people with me wrote to abu Ja’far, al-Thaniy (a.s.), asking about a man who commits the indecent act with a woman, then marries her after she becomes pregnant and gives birth to a child who of all creatures is similar to him. He (the Imam) wrote back in his handwriting the answer that said
فَقَالَ لَا يُورَثُ مِنْهُ إِنَّ رَسُولَ اللَّهِ ص قَالَ الْوَلَدُ لِلْفِرَاشِ وَ لِلْعَاهِرِ الْحَجَرُ وَ لَا يُورَثُ وَلَدَ الزِّنَا إِلَّا رَجُلٌ يَدَّعِي ابْنَ وَلِيدَتِهِ.

الرَّجْمُ حَدُّ اللَّهِ الْأَكْبَرُ وَ الْجَلْدُ حَدُّ اللَّهِ الْأَصْغَرُ فَإِذَا زَنَى الرَّجُلُ الْمُحْصَنُ يُرْجَمُ وَ لَمْ يُجْلَدْ.
Muhammad Bin Yahya narrated to me, and someone else, from Ahmad Bin Muhammad Bin Isa, from Al Husayn Bin Saeed, from Al Nazar Bin Suweyd, from Aasim Bin Humeyd, from Abu Baseer, Abu Abdullah asws has said: ‘The stoning is a bigger Penalty ( Hadd ) of Allah azwj and the whipping is the smaller Penalty ( Hadd ) of Allah
الْحُرُّ وَ الْحُرَّةُ إِذَا زَنَيَا جُلِدَ كُلُّ وَاحِدٍ مِنْهُمَا مِائَةَ جَلْدَةٍ فَأَمَّا الْمُحْصَنُ وَ الْمُحْصَنَةُ فَعَلَيْهِمَا الرَّجْمُ.
Ali Bin Ibrahim, from Muhammad Bin Isa, from Ubeyd, from Yunus, from Sama’at, Abu Abdullah asws has said: ‘The free man and the free woman, when they commit adultery, every one of the two would be whipped with one hundred lashes. So, as for the married man and the married woman, upon the both of them is the stoning’.
قَالَ أَبُو عَبْدِ اللَّهِ ع الرَّجْمُ فِي الْقُرْآنِ قَوْلُ اللَّهِ عَزَّ وَ جَلَّ إِذَا زَنَى الشَّيْخُ وَ الشَّيْخَةُ فَارْجُمُوهُمَا الْبَتَّةَ فَإِنَّهُمَا قَضَيَا الشَّهْوَةَ[1].
And by his chain, form Yunus, from Abdullah Bin Sinan who said, ‘Abu Abdullah asws said; ‘The stoning is in the Quran, the Words of Allah azwj Mighty and Majestic. When the old man and the old woman commit adultery, so stone both of them regardless, (because) for these two the lustful desire has expired’.
الَّذِي لَمْ يُحْصَنْ يُجْلَدُ مِائَةَ جَلْدَةٍ وَ لَا يُنْفَى وَ الَّذِي قَدْ أُمْلِكَ وَ لَمْ يَدْخُلْ بِهَا يُجْلَدُ مِائَةً وَ يُنْفَى.
A number of our companions, from Ahmad Bin Muhammad,f rom Al Husayn Bin Saeed, from Fazalat, from Musa Bin Bakr, from Zurara, Abu Ja’far asws has said: ‘(For adultery), the one who is not married, he should be whipped one hundred lashes, and he would not be exiled, and the one who has a slave girl and did not copulate
قَضَى أَمِيرُ الْمُؤْمِنِينَ ع فِي الشَّيْخِ وَ الشَّيْخَةِ أَنْ يُجْلَدَا مِائَةً وَ قَضَى لِلْمُحْصَنِ الرَّجْمَ وَ قَضَى فِي الْبِكْرِ وَ الْبِكْرَةِ إِذَا زَنَيَا جَلْدَ مِائَةٍ وَ نَفْيَ سَنَةٍ فِي غَيْرِ مِصْرِهِمَا وَ هُمَا اللَّذَانِ قَدْ أُمْلِكَا وَ لَمْ يَدْخُلَا بِهَا.

سَأَلْتُ أَبَا إِبْرَاهِيمَ ع- عَنْ رَجُلٍ إِذَا هُوَ زَنَى وَ عِنْدَهُ السُّرِّيَّةُ وَ الْأَمَةُ يَطَؤُهَا تُحْصِنُهُ الْأَمَةُ وَ تَكُونُ عِنْدَهُ فَقَالَ نَعَمْ إِنَّمَا ذَلِكَ لِأَنَّ عِنْدَهُ مَا يُغْنِيهِ عَنِ الزِّنَى قُلْتُ فَإِنْ كَانَتْ عِنْدَهُ أَمَةٌ زَعَمَ أَنَّهُ لَا يَطَؤُهَا فَقَالَ لَا يُصَدَّقُ قُلْتُ فَإِنْ كَانَتْ عِنْدَهُ امْرَأَةٌ مُتْعَةً أَ تُحْصِنُهُ قَالَ لَا إِنَّمَا هُوَ عَلَى الشَّيْءِ

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنْ رَجُلٍ لَهُ امْرَأَةٌ بِالْعِرَاقِ فَأَصَابَ فُجُوراً وَ هُوَ بِالْحِجَازِ فَقَالَ يُضْرَبُ حَدَّ الزَّانِي مِائَةَ جَلْدَةٍ وَ لَا يُرْجَمُ قُلْتُ فَإِنْ كَانَ مَعَهَا فِي بَلْدَةٍ وَاحِدَةٍ وَ هُوَ مَحْبُوسٌ فِي سِجْنٍ لَا يَقْدِرُ أَنْ يَخْرُجَ إِلَيْهَا وَ لَا تَدْخُلَ هِيَ عَلَيْهِ أَ رَأَيْتَ إِنْ زَنَى فِي السِّجْنِ قَالَ هُوَ بِمَنْزِلَةِ الْغَائِبِ عَنْ أَهْلِهِ يُجْلَدُ
Muhammad Bin Yahya, from Ahmad Bin Muhammad Bin Isa, from Ibn Mahboub, from Rabie Al Asam, from Al Haris Bin Al Mugheira who said, ‘I asked Abu Abdullah asws about a man, for him is a woman at Al-Iraq, so he committed immorality and he was at Al-Hijaz. سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ الْمُحْصَنِ قَالَ فَقَالَ الَّذِي يَزْنِي وَ عِنْدَهُ مَا يُغْنِيهِ.
Ali Bin Ibrahim, from Muhammad Bin Isa Bin Ubeyd, from Yunus, from Hareyz who said, ‘I asked Abu Abdullah asws about the married man, so he asws said: ‘The one who commits adultery and with him is what makes him to be needless of it’.
سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع- عَنْ رَجُلٍ يَزْنِي قَبْلَ أَنْ يَدْخُلَ بِأَهْلِهِ أَ يُرْجَمُ قَالَ لَا.
A number of our companions, from Ahmad Bin Muhammad, from Al Husayn Bin Saeed, from Fazalat Bin Ayoub, from Rafa’at who said, ‘I asked Abu Abdullah asws about a man who commited adultery before he copulated with his wife, would he be stoned?’ He asws said: ‘No’.
الْحَدُّ فِي السَّفَرِ الَّذِي إِذَا زَنَى لَمْ يُرْجَمْ إِنْ كَانَ مُحْصَناً قَالَ إِذَا قَصَّرَ وَ أَفْطَرَ.
Muhammad Bin Yahya, from Muhammad Bin Al Husayn, (It has been narrated) that he asws said, ‘The Penalty (Hadd) during the travel for the one who commits adultery, he would not be stoned even if he was married, (a journey where he has to) shorten (the Prayer) and break the Fast’.
قَضَى أَمِيرُ الْمُؤْمِنِينَ ع فِي الرَّجُلِ الَّذِي لَهُ امْرَأَةٌ بِالْبَصْرَةِ فَفَجَرَ بِالْكُوفَةِ أَنْ يُدْرَأَ عَنْهُ الرَّجْمُ وَ يُضْرَبَ حَدَّ الزَّانِي قَالَ وَ قَضَى ع فِي رَجُلٍ مَحْبُوسٍ فِي السِّجْنِ وَ لَهُ امْرَأَةٌ حُرَّةٌ فِي بَيْتِهِ فِي الْمِصْرِ وَ هُوَ لَا يَصِلُ إِلَيْهَا فَزَنَى فِي السِّجْنِ قَالَ عَلَيْهِ الْجَلْدُ وَ يُدْرَأُ عَنْهُ الرَّجْمُ.
Ali Bin Ibrahim, from his father, from Ibn Mahboub, from Abu Ayoub, from Abu Ubeyda, (It has been narrated) from Abu Ja’far asws having said: ‘Amir Al-Momineen asws had judged with regards to the man who had a woman for him at Al-Basra, so he committed immorality at Al-Kufa, that the stoning be staved off (eliminated)
قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع أَخْبِرْنِي عَنِ الْغَائِبِ عَنْ أَهْلِهِ يَزْنِي هَلْ يُرْجَمُ إِذَا كَانَتْ لَهُ زَوْجَةٌ وَ هُوَ غَائِبٌ عَنْهَا قَالَ لَا يُرْجَمُ الْغَائِبُ عَنْ أَهْلِهِ وَ لَا الْمُمْلَكُ الَّذِي لَمْ يَبْنِ بِأَهْلِهِ[1] وَ لَا صَاحِبُ الْمُتْعَةِ قُلْتُ فَفِي أَيِّ حَدِّ سَفَرِهِ لَا يَكُونُ مُحْصَناً قَالَ إِذَا قَصَّرَ وَ أَفْطَرَ فَلَيْسَ بِمُحْصَنٍ.

يُجْلَدُ الْغُلَامُ دُونَ الْحَدِّ وَ تُجْلَدُ الْمَرْأَةُ الْحَدَّ كَامِلًا قِيلَ لَهُ فَإِنْ كَانَتْ مُحْصَنَةً قَالَ لَا تُرْجَمُ لِأَنَّ الَّذِي نَكَحَهَا لَيْسَ بِمُدْرِكٍ وَ لَوْ كَانَ مُدْرِكاً رُجِمَتْ.
Ali Bin Ibrahim, from his father and Muhammad Bin Yahya, from Ahmad Bin Muhammad, altogether from Ibn Mahboub, from Abu Ayoub Al Khazaz, from Suleyman Bin Khalid, from Abu Baseer, (It has been narrated) from Abu Abdullah asws regarding a young boy who had not matured yet, a boy ten years of age, committed adultery with
سَمِعْتُهُ يَقُولُ حَدُّ الْجَلْدِ فِي الزِّنَى أَنْ يُوجَدَا فِي لِحَافٍ وَاحِدٍ وَ الرَّجُلَانِ يُوجَدَانِ فِي لِحَافٍ وَاحِدٍ وَ الْمَرْأَتَانِ تُوجَدَانِ فِي لِحَافٍ وَاحِدٍ.
Ali, from his father, from Ibn Mahboub, from Abdullah Bin Sinan, (The narrator) says, ‘I heard Abu Abdullah asws saying: ‘The Penalty ( Hadd ) of the whipping (is applied) in the adultery if you find two to be in one quilt, and the two men both found to be in one quilt, and the two women both found to be in one quilt’.
كَانَ عَلِيٌّ ع إِذَا وَجَدَ رَجُلَيْنِ فِي لِحَافٍ وَاحِدٍ مُجَرَّدَيْنِ جَلَدَهُمَا حَدَّ الزَّانِي مِائَةَ جَلْدَةٍ كُلَّ وَاحِدٍ مِنْهُمَا وَ كَذَا الْمَرْأَتَانِ إِذَا وُجِدَتَا فِي لِحَافٍ وَاحِدٍ مُجَرَّدَتَيْنِ جَلَدَ كُلَّ وَاحِدَةٍ مِنْهُمَا مِائَةَ جَلْدَةٍ.
Ali Bin Ibrahim, from his father, from Ibn Mahboub, from Abu Ayoub, from Abu Ubeyda, (It has been narrated) from Abu Ja’far asws having said: ‘Ali asws , whenever he asws found two men in one quilt, naked, would whip both of them the Penalty ( Hadd ) of the adultery, one hundred lashes, each one of them, and similarly

A number of our companions, from Sahl Bin Ziyad, from Muhammad Bin Al Hassan Al Basry, from Hammad Bin Isa, from Shuayb Al Aqarquqy, from Abu Baseer, (It has been narrated) from Abu Abdullah asws having said: ‘The Penalty ( Hadd ) of the stoning regarding the adultery is that four should testify that they had seen him
قُلْتُ لِأَبِي الْحَسَنِ ع- أَخْبِرْنِي عَنِ الْمُحْصَنِ إِذَا هُوَ هَرَبَ مِنَ الْحَفِيرَةِ هَلْ يُرَدُّ حَتَّى يُقَامَ عَلَيْهِ الْحَدُّ فَقَالَ يُرَدُّ وَ لَا يُرَدُّ فَقُلْتُ وَ كَيْفَ ذَلِكَ فَقَالَ إِذَا كَانَ هُوَ الْمُقِرَّ عَلَى نَفْسِهِ ثُمَّ هَرَبَ مِنَ الْحَفِيرَةِ بَعْدَ مَا يُصِيبُهُ شَيْءٌ مِنَ الْحِجَارَةِ لَمْ يُرَدَّ وَ إِنْ كَانَ إِنَّمَا قَامَتْ عَلَيْهِ الْبَيِّنَةُ وَ هُوَ يَجْحَدُ ثُمَّ هَرَبَ

قَالَ أَبُو عَبْدِ اللَّهِ ع أَتَى النَّبِيَّ ص رَجُلٌ فَقَالَ إِنِّي زَنَيْتُ فَطَهِّرْنِي فَصَرَفَ النَّبِيُّ ص وَجْهَهُ عَنْهُ فَأَتَاهُ مِنْ جَانِبِهِ الْآخَرِ ثُمَّ قَالَ مِثْلَ مَا قَالَ فَصَرَفَ وَجْهَهُ عَنْهُ ثُمَّ جَاءَ الثَّالِثَةَ فَقَالَ لَهُ يَا رَسُولَ اللَّهِ إِنِّي زَنَيْتُ وَ عَذَابُ الدُّنْيَا أَهْوَنُ لِي مِنْ عَذَابِ الْآخِرَةِ فَقَالَ رَسُولُ اللَّهِ ص أَ بِصَاحِبِكُمْ بَأْسٌ يَعْنِي جِنَّةً فَ
Ali Bin Ibrahim, from Muhammad Bin Isa, from Yunus, from Aban, from Abu Al Abbas who said, ‘Abu Abdullah asws said: ‘A man came over to the Prophet saww so he said, ‘I have committed adultery, so purify me’. So the Prophet saww turned his saww face away from him. So he came over from his saww other side, then said simi
أَتَتِ امْرَأَةٌ مُجِحٌّ أَمِيرَ الْمُؤْمِنِينَ ع[1] فَقَالَتْ يَا أَمِيرَ الْمُؤْمِنِينَ إِنِّي زَنَيْتُ فَطَهِّرْنِي طَهَّرَكَ اللَّهُ فَإِنَّ عَذَابَ الدُّنْيَا أَيْسَرُ مِنْ عَذَابِ الْآخِرَةِ الَّذِي لَا يَنْقَطِعُ فَقَالَ لَهَا مِمَّا أُطَهِّرُكِ فَقَالَتْ إِنِّي زَنَيْتُ فَقَالَ لَهَا أَ وَ ذَاتُ بَعْلٍ أَنْتِ أَمْ غَيْرُ ذَلِكِ فَقَالَتْ بَلْ ذَاتُ بَعْلٍ فَقَالَ لَهَا أَ فَحَاضِراً كَانَ بَعْلُكِ إِذْ فَعَل
Ali Bin Ibrahim, form his father, form Ibn Mahboub, from Ali Bin Abu Hamza, from Abu Baseer, from Imran Bin Maysam, or Salih Bin Maysam, from his father who said, ‘A woman came over to Amir Al-Momineen asws , so she said, ‘O Amir Al-Momineen asws ! I have committed adultery, so purify me, may Allah azwj Purify you asws
أَتَاهُ رَجُلٌ بِالْكُوفَةِ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ إِنِّي زَنَيْتُ فَطَهِّرْنِي قَالَ مِمَّنْ أَنْتَ قَالَ مِنْ مُزَيْنَةَ قَالَ أَ تَقْرَأُ مِنَ الْقُرْآنِ شَيْئاً قَالَ بَلَى قَالَ فَاقْرَأْ فَقَرَأَ فَأَجَادَ فَقَالَ أَ بِكَ جِنَّةٌ قَالَ لَا قَالَ فَاذْهَبْ حَتَّى نَسْأَلَ عَنْكَ فَذَهَبَ الرَّجُلُ ثُمَّ رَجَعَ إِلَيْهِ بَعْدُ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ إِنِّي زَنَيْتُ فَطَهِّرْنِي فَقَالَ أَ
Ali Bin Ibrahim, from Ahmad Bin Muhammad Bin Khalid, (It has been narrated) raising it to Amir Al-Momineen asws , said, ‘A man came over to him asws at Al-Kufa, so he said, ‘O Amir Al-Momineen asws ! I had committed adultery, so purify me’. He asws said: ‘From where are you (coming from)?’ He said, ‘From Muzeyna’. He a
سُئِلَ أَبُو جَعْفَرٍ ع- عَنْ رَجُلٍ اغْتَصَبَ امْرَأَةً فَرْجَهَا قَالَ يُقْتَلُ مُحْصَناً كَانَ أَوْ غَيْرَ مُحْصَنٍ.
Ali Bin Ibrahim, from his father and Muhammad Bin Yahya, from Ahmad Bin Muhammad, altogether from Ibn Mahboub, from Abu Ayoub, from Bureyd Al ajaly who said, ‘Abu Ja’far asws was asked about a man who raped a woman of her chastity. He asws said: ‘He should be killed, whether he was married or without marriage’.
سَمِعْتُ بُكَيْرَ بْنَ أَعْيَنَ يَرْوِي عَنْ أَحَدِهِمَا ع قَالَ: مَنْ زَنَى بِذَاتِ مَحْرَمٍ حَتَّى يُوَاقِعَهَا ضُرِبَ ضَرْبَةً بِالسَّيْفِ أَخَذَتْ مِنْهُ مَا أَخَذَتْ وَ إِنْ كَانَتْ تَابَعَتْهُ ضُرِبَتْ ضَرْبَةً بِالسَّيْفِ أَخَذَتْ مِنْهَا مَا أَخَذَتْ قِيلَ لَهُ فَمَنْ يَضْرِبُهُمَا وَ لَيْسَ لَهُمَا خَصْمٌ قَالَ ذَاكَ عَلَى الْإِمَامِ إِذَا رُفِعَا إِلَيْهِ.
Ali Bin Ibrahim, from his father, from Ibn Mahboub, from Abu Ayoub who said, ‘I heard Bukeyr Bin Ayn narrating, (It has been narrated either) from one the two (5 th or 6 th Imam asws ) having said: ‘The one who commits adultery with a Mahram (commits incest) until he falls upon her, would be struck with one strike of t
قَالَ أَبُو عَبْدِ اللَّهِ ع الزَّانِي إِذَا زَنَى جُلِدَ ثَلَاثاً وَ يُقْتَلُ فِي الرَّابِعَةِ يَعْنِي إِذَا جُلِدَ ثَلَاثَ مَرَّاتٍ.
