أَنَّهُ كَرِهَ صَيْدَ الْبَازِي إِلَّا مَا أُدْرِكَتْ ذَكَاتُهُ.
“Abu Ja‘far (a.s.), disliked what a falcon hunted unless one arrived in time to slaughter it properly.’”

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنْ رَجُلٍ أَرْسَلَ بَازَهُ أَوْ كَلْبَهُ فَأَخَذَ صَيْداً وَ أَكَلَ مِنْهُ آكُلُ مِنْ فَضْلِهِمَا فَقَالَ لَا مَا قَتَلَ الْبَازِي فَلَا تَأْكُلْ مِنْهُ إِلَّا أَنْ تَذْبَحَهُ.
“I once asked abu ‘Abd Allah (a.s.), about the case of a man who sends his falcon or dog to catch a prey which then catches a prey and eats thereof; if he can use the remaining for food. He (the Imam) said, ‘No, do not use for food what the falcon kills, unless you slaughter it properly.’”
سَأَلْتُهُ عَنْ صَيْدِ الْبَازِي وَ الصَّقْرِ فَقَالَ لَا تَأْكُلْ مَا قَتَلَ الْبَازِي وَ الصَّقْرُ وَ لَا تَأْكُلْ مَا قَتَلَ سِبَاعُ الطَّيْرِ.
‘Do not use for food what falcons and hawks kill as well as what the predator birds kill.’”
قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع مَا تَقُولُ فِي الْبَازِي وَ الصَّقْرِ وَ الْعُقَابِ فَقَالَ إِنْ أَدْرَكْتَ ذَكَاتَهُ فَكُلْ مِنْهُ وَ إِنْ لَمْ تُدْرِكْ ذَكَاتَهُ فَلَا تَأْكُلْ.
‘If you arrive in time to slaughter it properly, then you can use it for food but if you do not arrive in time then do not use it for food.’”
سَمِعْتُ أَبَا عَبْدِ اللَّهِ ع يَقُولُ كَانَ أَبِي ع يُفْتِي فِي زَمَنِ بَنِي أُمَيَّةَ أَنَّ مَا قَتَلَ الْبَازِي وَ الصَّقْرُ فَهُوَ حَلَالٌ وَ كَانَ يَتَّقِيهِمْ وَ أَنَا لَا أَتَّقِيهِمْ وَ هُوَ حَرَامٌ مَا قَتَلَ[1].
“I once heard abu ‘Abd Allah (a.s.), saying, ‘In the time of banu ‘Umayyah my father (a.s.), would give fatwa that what falcons and hawks kill is lawful for food. He (the Imam) was afraid but I am not afraid and I say that it (what is hunted by falcons and hawks) is not lawful to use for food.”’
سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنْ صَيْدِ الْبَازِي إِذَا صَادَ وَ قَتَلَ وَ أَكَلَ مِنْهُ آكُلُ مِنْ فَضْلِهِ أَمْ لَا فَقَالَ أَمَّا مَا أَكَلَتِ الطَّيْرُ فَلَا تَأْكُلْ إِلَّا أَنْ تُذَكِّيَهُ.
“I once asked abu ‘Abd Allah (a.s.), about the hunting of falcons which it catches and eats thereof; if the remaining can be used for food. He (the Imam) said, ‘Whatever birds eat do not use it for food unless you slaughter it properly.’”
سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ الصُّقُورِ وَ الْبُزَاةِ وَ عَنْ صَيْدِهَا فَقَالَ كُلْ مَا لَمْ يَقْتُلْنَ إِذَا أَدْرَكْتَ ذَكَاتَهُ وَ آخِرُ الذَّكَاةِ إِذَا كَانَتِ الْعَيْنُ تَطْرِفُ وَ الرِّجْلُ تَرْكُضُ وَ الذَّنَبُ تَتَحَرَّكُ وَ قَالَ ع لَيْسَتِ الصُّقُورُ وَ الْبُزَاةُ فِي الْقُرْآنِ.
“I once asked abu ‘Abd Allah (a.s.), about falcons and hawks and their hunting. He (the Imam) said, ‘Whatever they have not killed and you have slaughtered properly, is lawful and the last time for slaughtering is when the eyes move, legs run and the tails move.’ He (the Imam) then said, ‘Hawks and falcons are not ment
لَا تَأْكُلْ مِمَّا قَتَلَتْ سِبَاعُ الطَّيْرِ.
“He (the Imam) (a.s.), has said, ‘Do not eat what predator birds kill.’”
سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنْ كَلْبِ الْمَجُوسِيِّ يَأْخُذُهُ الرَّجُلُ الْمُسْلِمُ فَيُسَمِّي حِينَ يُرْسِلُهُ أَ يَأْكُلُ مِمَّا أَمْسَكَ عَلَيْهِ قَالَ نَعَمْ لِأَنَّهُ مُكَلَّبٌ قَدْ ذَكَرَ اسْمَ اللَّهِ عَلَيْهِ[1].
“I once asked abu ‘ Abd Allah (a.s.), about the dog that belongs to a Zoroastrian person; if a Muslim person can take and send it to catch a prey and mentions the name of Allah and if he can use the hunt for food. He (the Imam) said, ‘Yes, because it is trained and he has mentioned the name of Allah.”’
قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع إِنِّي أَسْتَعِيرُ كَلْبَ الْمَجُوسِيِّ فَأَصِيدُ بِهِ فَقَالَ ع لَا تَأْكُلْ مِنْ صَيْدِهِ إِلَّا أَنْ يَكُونَ عَلَّمَهُ مُسْلِمٌ فَتَعَلَّمَهُ.
‘Do not use it for food unless a Muslim has trained it and it has learned.’”
كَلْبُ الْمَجُوسِيِّ لَا تَأْكُلْ صَيْدَهُ إِلَّا أَنْ يَأْخُذَهُ الْمُسْلِمُ فَيُعَلِّمَهُ وَ يُرْسِلَهُ وَ كَذَلِكَ الْبَازِي وَ كِلَابُ أَهْلِ الذِّمَّةِ وَ بُزَاتُهُمْ حَلَالٌ لِلْمُسْلِمِينَ أَنْ يَأْكُلُوا صَيْدَهَا.
“Abu ‘Abd Allah (a.s.), has said, ‘Do not use for food what the dog of a Zoroastrian person hunts, unless a Muslim has taken it to train and sends it to hunt. This applies to what the dogs of taxpayers and their falcons hunt, thus, it is lawful for the Muslims to use for food.’”
كُلْ مِنَ الصَّيْدِ مَا قَتَلَ السَّيْفُ وَ السَّهْمُ وَ الرُّمْحُ وَ سُئِلَ عَنْ صَيْدٍ صِيدَ فَتَوَزَّعَهُ الْقَوْمُ قَبْلَ أَنْ يَمُوتَ فَقَالَ لَا بَأْسَ بِهِ[2].
“Abu Ja’far (a.s.), has said, ‘Whatever is hunted by swords, arrows and spears are lawful to use for food.’ He (the Imam) was asked about the prey, which is assigned to several people in portions before it dies. He (the Imam) said, ‘It is not unlawful.’”
مَنْ جَرَحَ صَيْداً بِسِلَاحٍ وَ ذَكَرَ اسْمَ اللَّهِ عَزَّ وَ جَلَّ عَلَيْهِ ثُمَّ بَقِيَ لَيْلَةً أَوْ لَيْلَتَيْنِ لَمْ يَأْكُلْ مِنْهُ سَبُعٌ وَ قَدْ عَلِمَ أَنَّ سِلَاحَهُ هُوَ الَّذِي قَتَلَهُ فَيَأْكُلُ مِنْهُ إِنْ شَاءَ وَ قَالَ فِي إِيَّلٍ[1] اصْطَادَهُ رَجُلٌ فَتَقَطَّعَهُ النَّاسُ وَ الرَّجُلُ يَتْبَعُهُ أَ فَتَرَاهُ نُهْبَةً فَقَالَ ع لَيْسَ بِنُهْبَةٍ[2] وَ لَيْسَ بِهِ بَأْسٌ.
‘If one causes injuries to a prey and mentions the name of Allah, most Majestic, most Glorious, then it remains for one or two nights without being eaten by the beasts; and he knows that his weapon is that which has caused its death, he can use it for food if he wants.’ About a mountain goat hunted by a man but people
سُئِلَ أَبُو عَبْدِ اللَّهِ ع عَنِ الرَّمِيَّةِ يَجِدُهَا صَاحِبُهَا فِي الْغَدِ أَ يَأْكُلُ مِنْهُ فَقَالَ إِنْ عَلِمَ أَنَّ رَمْيَتَهُ هِيَ الَّتِي قَتَلَتْهُ فَلْيَأْكُلْ مِنْ ذَلِكَ إِذَا كَانَ قَدْ سَمَّى[3].
“Once abu ‘Abd Allah (a.s.), was asked about the prey which his owner finds the next day; if he can use it for food. He (the Imam) said, ‘If he knows that it is the prey which he had killed, he can use it for food if he had mentioned the name of Allah.’”
سَأَلْتُهُ عَنْ رَجُلٍ رَمَى حِمَارَ وَحْشٍ أَوْ ظَبْياً فَأَصَابَهُ ثُمَّ كَانَ فِي طَلَبِهِ فَوَجَدَهُ مِنَ الْغَدِ وَ سَهْمُهُ فِيهِ فَقَالَ إِنْ عَلِمَ أَنَّهُ أَصَابَهُ وَ أَنَّ سَهْمَهُ هُوَ الَّذِي قَتَلَهُ فَلْيَأْكُلْ مِنْهُ وَ إِلَّا فَلَا يَأْكُلْ مِنْهُ.
“I once asked him (the Imam) (a.s.), about the case of a man who shoots a wild donkey or a deer which is shot and he searches for it but finds it the next day with his arrow in it. He (the Imam) said, ‘If he knows that his shot had hit it and the arrow is his arrow which has killed it, he then can use it for food, othe
قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع أَرْمِي سَهْمِي وَ لَا أَدْرِي أَ سَمَّيْتُ أَمْ لَمْ أُسَمِّ فَقَالَ كُلْ لَا بَأْسَ[4] قَالَ قُلْتُ أَرْمِي وَ يَغِيبُ عَنِّي فَأَجِدُ سَهْمِي فِيهِ فَقَالَ كُلْ مَا لَمْ يُؤْكَلْ مِنْهُ وَ إِنْ كَانَ قَدْ أُكِلَ مِنْهُ فَلَا تَأْكُلْ مِنْهُ.
“I once said to abu ‘Abd Allah (a.s.), ‘I shoot my arrow but I am not certain if I mentioned the name of Allah or not.’ He (the Imam) said, ‘You can use it for food and it is not unlawful.’ I then asked, ‘What happens if I shoot and the prey disappears, then I find it with my arrow in it. He (the Imam) said, ‘You can u
سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ الصَّيْدِ يَضْرِبُهُ الرَّجُلُ بِالسَّيْفِ أَوْ يَطْعُنُهُ بِالرُّمْحِ أَوْ يَرْمِيهِ بِسَهْمٍ فَقَتَلَهُ وَ قَدْ سَمَّى حِينَ فَعَلَ ذَلِكَ فَقَالَ كُلْ لَا بَأْسَ بِهِ.
“I once asked abu ‘Abd Allah (a.s.), about a prey that a man hits with a sword or with a spear or shoots with an arrow and kills, and he has mentioned the name of Allah when shooting. He (the Imam) said, ‘You can use it for food and it is not unlawful.’”
سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ الرَّمِيَّةِ يَجِدُهَا صَاحِبُهَا أَ يَأْكُلُهَا قَالَ إِنْ كَانَ يَعْلَمُ أَنَّ رَمْيَتَهُ هِيَ الَّتِي قَتَلَتْهُ فَلْيَأْكُلْ.
“I once asked abu ‘ Abd Allah (a.s.), about a prey that its owner finds; if he can use it for food. He (the Imam) said, ’If he knows that it is his shot that has killed it, he can use it for food.’”
قَالَ أَمِيرُ الْمُؤْمِنِينَ ع فِي صَيْدٍ وُجِدَ فِيهِ سَهْمٌ وَ هُوَ مَيِّتٌ لَا يُدْرَى مَنْ قَتَلَهُ قَالَ لَا تَطْعَمْهُ[1].
“Abu Ja’far (a.s.), has said that ’Amir al-Mu’minin, about a prey that is found dead with an arrow in it and it is not known who has killed it, said, ’Do not use it for food.’”
سَأَلْتُهُ ع عَنِ الرَّجُلِ يَرْمِي الصَّيْدَ فَيَصْرَعُهُ فَيَبْتَدِرُهُ الْقَوْمُ فَيُقَطِّعُونَهُ فَقَالَ كُلْهُ[2].
“I once asked him (the Imam) (a.s.), about the case of a man who shoots a prey and hits it. People before him come and interrupt him. He (the Imam) said, ‘He can use it for food.”’
إِذَا رَمَيْتَ فَوَجَدْتَهُ وَ لَيْسَ بِهِ أَثَرٌ غَيْرُ السَّهْمِ وَ تَرَى أَنَّهُ لَمْ يَقْتُلْهُ غَيْرُ سَهْمِكَ فَكُلْ غَابَ عَنْكَ أَوْ لَمْ يَغِبْ عَنْكَ.
“Abu ‘Abd Allah (a.s.), has said, ‘If you shoot a prey then find it without any other marks except your arrow and you know that nothing other than your arrow has killed it, you can use it for food, regardless, it had disappeared from you or not.’”
سَأَلْتُ أَبَا عَبْدِ اللَّهِ عَنِ الرَّجُلِ يَرْمِي الصَّيْدَ وَ هُوَ عَلَى الْجَبَلِ فَيَخْرِقُهُ السَّهْمُ حَتَّى يَخْرُجَ مِنَ الْجَانِبِ الْآخَرِ قَالَ كُلْهُ قَالَ فَإِنْ وَقَعَ فِي مَاءٍ أَوْ تَدَهْدَهَ مِنَ الْجَبَلِ فَمَاتَ فَلَا تَأْكُلْهُ[4].
“I once asked abu ‘Abd Allah (a.s.), about the case of a man who shoots a prey from the mountain and the arrow pierces through and comes out from the other side. He (the Imam) said, ‘He can use it for food. ‘He (the Imam) said, ‘If it falls in water or rolls down the mountain and dies then do not use it for food.’”
قَالَ أَبُو عَبْدِ اللَّهِ ع لَا يُرْمَى الصَّيْدُ بِشَيْءٍ هُوَ أَكْبَرُ مِنْهُ[5].
“Abu ‘Abd Allah (a.s.), has said, ‘A prey must not be hit with something bigger than the prey.’” (It is because the cause of death becomes confused with the weight and force of the hunter).
لَا بَأْسَ إِذَا كَانَ هُوَ مِرْمَاتَكَ أَوْ صَنَعْتَهُ لِذَلِكَ[2].
’It is not unlawful if it is what you have shot and it is what you have made for it.’”
إِنْ لَمْ يَكُنْ لَهُ نَبْلٌ غَيْرُ الْمِعْرَاضِ وَ ذَكَرَ اسْمَ اللَّهِ عَزَّ وَ جَلَّ عَلَيْهِ فَلْيَأْكُلْ مَا قَتَلَ قُلْتُ وَ إِنْ كَانَ لَهُ نَبْلٌ غَيْرُهُ قَالَ لَا.
‘If he does not have any other arrow and has mentioned the name of Allah, most Majestic, most Glorious, he can use it for food. If he has other arrows then he cannot use it for food.’”
إِذَا رَمَيْتَ بِالْمِعْرَاضِ فَخَرَقَ[3] فَكُلْ وَ إِنْ لَمْ يَخْرِقْ وَ اعْتَرَضَ فَلَا تَأْكُلْ.
“Abu ‘Abd Allah (a.s.), has said, ‘If you shoot the prey with flareless arrow and if it pierces into the prey you can use it for food; but if it does not pierce into the prey and hits it widthwise, then do not use it for food.”’
سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع- عَنِ الصَّيْدِ يَرْمِيهِ الرَّجُلُ بِسَهْمٍ فَيُصِيبُهُ مُعْتَرِضاً فَيَقْتُلُهُ وَ قَدْ كَانَ سَمَّى حِينَ رَمَى وَ لَمْ تُصِبْهُ الْحَدِيدَةُ فَقَالَ إِنْ كَانَ السَّهْمُ الَّذِي أَصَابَهُ هُوَ الَّذِي قَتَلَهُ فَإِذَا رَآهُ فَلْيَأْكُلْ.
“I once asked abu ‘Abd Allah (a.s.), about a prey that is shot by a man with an arrow and it hits widthwise and kills it. He had mentioned the name of Allah when shooting but no iron has hit the prey. He (the Imam) said, ‘If the arrow that has hit is the one that has caused its death and he has seen it, he can use it f
سَأَلْتُهُ عَنِ الصَّيْدِ يُصِيبُهُ السَّهْمُ مُعْتَرِضاً وَ لَمْ يُصِبْهُ بِحَدِيدَةٍ وَ قَدْ سَمَّى حِينَ رَمَى قَالَ يَأْكُلُهُ إِذَا أَصَابَهُ وَ هُوَ يَرَاهُ وَ عَنْ صَيْدِ الْمِعْرَاضِ فَقَالَ إِنْ لَمْ يَكُنْ لَهُ نَبْلٌ غَيْرُهُ وَ كَانَ قَدْ سَمَّى حِينَ رَمَى فَلْيَأْكُلْ مِنْهُ وَ إِنْ كَانَ لَهُ نَبْلٌ غَيْرُهُ فَلَا.
“I once asked abu ‘Abd Allah (a.s.), about a prey which is hit by an arrow widthwise and no iron part has hit it. He had mentioned the name of Allah when shooting. He (the Imam) said, ‘He can use it for food if it hits and he sees it hitting.’ I asked him (the Imam) about hunting with flareless arrows. He (the Imam) sa
أَنَّهُ سُئِلَ عَمَّا قَتَلَ الْحَجَرُ وَ الْبُنْدُقُ أَ يُؤْكَلُ مِنْهُ قَالَ لَا.
“Once, abu ‘ Abd Allah (a.s.), was asked about a prey killed by stone or clay-ball; if it is edible. He (the Imam) said, ‘No, it cannot be used for food. 5 ”
سَأَلْتُهُ عَمَّا قَتَلَ الْحَجَرُ وَ الْبُنْدُقُ أَ يُؤْكَلُ مِنْهُ قَالَ لَا.
“I once asked one of the two Imam, (abu Ja‘far or abu ‘Abd Allah), ‘Alayhim al-Salam, about a prey killed with a stone or clay-ball; if it can be used for food. He (the Imam) said, ‘No, it is not edible.’”
سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَمَّا قَتَلَ الْحَجَرُ وَ الْبُنْدُقُ أَ يُؤْكَلُ مِنْهُ قَالَ لَا.
“I once asked abu ‘Abd Allah (a.s.), about a prey killed with a stone or clay-ball; if it can be used for food. He (the Imam) said, ‘No, it is not edible.’”
أَنَّهُ سُئِلَ عَمَّا قَتَلَ الْحَجَرُ وَ الْبُنْدُقُ أَ يُؤْكَلُ مِنْهُ قَالَ لَا.
“Once abu ‘Abd Allah (a.s.), was asked about the prey killed with a stone or a clay-ball if it is edible. He (the Imam) said, ‘No, it is not edible.’”
سَأَلْتُهُ عَنْ قَتْلِ الْحَجَرِ وَ الْبُنْدُقِ أَ يُؤْكَلُ مِنْهُ فَقَالَ لَا.
“Once, I asked one of the two Imam, (abu Ja‘far or abu ‘Abd Allah) (a.s.), about a prey. A stone or clay-ball kills it if it is edible. He (the Imam) said, ‘No, it is not edible.’”
أَنَّهُ كَرِهَ الْجُلَاهِقَ[1].
“Abu ‘Abd Allah (a.s.), disliked al-Julahiq (a kind of clay-ball).”
فِي الرَّجُلِ يَرْمِي بِالْبُنْدُقِ وَ الْحَجَرِ فَيَقْتُلُ أَ فَيَأْكُلُ مِنْهُ قَالَ لَا تَأْكُلْ.
“About the case of a man who hits a prey with a stone or clay-ball and kills it; if he can use it for food, he (the Imam) said, ‘Do not eat it.’”
قَالَ أَمِيرُ الْمُؤْمِنِينَ ع مَا أَخَذَتِ الْحِبَالَةُ مِنْ صَيْدٍ فَقَطَعَتْ مِنْهُ يَداً أَوْ رِجْلًا فَذَرُوهُ فَإِنَّهُ مَيِّتٌ وَ كُلُوا مَا أَدْرَكْتُمْ حَيّاً وَ ذَكَرْتُمُ اسْمَ اللَّهِ عَزَّ وَ جَلَّ عَلَيْهِ.
“Abu Ja‘far (a.s.), has said that ’Amir al-Mu’minin has said, ’If a prey is caught by a snare, whatever is cut off like a leg or so, must be thrown away; it is dead. You can use the rest that you find alive and the name of Allah was mentioned on it.’”
مَا أَخَذَتِ الْحِبَالَةُ فَقَطَعَتْ مِنْهُ شَيْئاً فَهُوَ مَيِّتٌ وَ مَا أَدْرَكْتَ مِنْ سَائِرِ جَسَدِهِ حَيّاً فَذَكِّهِ ثُمَّ كُلْ مِنْهُ.
“Abu ‘Abd Allah (a.s.), has said, ‘If a prey is caught in a snare and certain part of it is cut off, it is dead, but what you find alive of the rest of the body you can slaughter it properly and use it for food.”’
مَا أَخَذَتِ الْحِبَالَةُ فَقَطَعَتْ مِنْهُ شَيْئاً فَهُوَ مَيِّتٌ وَ مَا أَدْرَكْتَ مِنْ سَائِرِ جَسَدِهِ حَيّاً فَذَكِّهِ ثُمَّ كُلْ مِنْهُ.
“Abu ‘Abd Allah (a.s.), has said, ‘Whatever of a prey is caught in the snare is dead and whatever of the rest of the body you find alive, slaughter it properly; then you can use it for food.’”
مَا أَخَذَتِ الْحِبَالَةُ فَانْقَطَعَ مِنْهُ شَيْءٌ أَوْ مَاتَ فَهُوَ مَيْتَةٌ.
‘Whatever of the prey is caught in the snare which is cut off or has died is dead.’”
مَا أَخَذَتِ الْحَبَائِلُ فَقَطَعَتْ مِنْهُ شَيْئاً فَهُوَ مَيِّتٌ وَ مَا أَدْرَكْتَ مِنْ سَائِرِ جَسَدِهِ فَذَكِّهِ ثُمَّ كُلْ مِنْهُ.
5. Aban has narrated from Zurarah who has said the following: “Abu Ja‘far (a.s.), has said, ‘Whatever of a prey is caught in the snare and is cutoff, it is dead, but what you find alive of the rest of the body, you can slaughter it properly and use it for food.’”
لَا تَأْكُلْ مِنَ الصَّيْدِ إِذَا وَقَعَ فِي الْمَاءِ فَمَاتَ.
“Abu al-Hassan (a.s.), has said, ‘Do not eat the prey that falls in water and dies.’”
كُلْ مِنْهُ وَ إِنْ وَقَعَ فِي الْمَاءِ مِنْ رَمْيَتِكَ فَمَاتَ فَلَا تَأْكُلْ مِنْهُ. - عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ عُمَيْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللَّهِ ع مِثْلَهُ- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ بَعْضِ أَصْحَابِنَا عَنْ هِشَامِ بْنِ سَالِمٍ عَنْ سَمَاعَةَ عَنْ أَبِي عَبْدِ اللَّهِ ع مِثْلَهُ.
2. A number of our people have narrated from Ahmad ibn Muhammad ibn Khalid from ‘Uthman ibn ‘Isa from Sama‘ah who has said the following: “Once abu ‘Abd Allah, ‘Alayhi al-Salam, was asked about the case of a man who shoots a prey on a mountain or wall. The arrow pierces into it and it dies. He (the Imam) said, ‘You can
سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنْ رَجُلٍ سَمَّى وَ رَمَى صَيْداً فَأَخْطَأَهُ وَ أَصَابَ آخَرَ فَقَالَ يَأْكُلُ مِنْهُ.
“I once asked abu ‘Abd Allah (a.s.), about the case of a man who shoots a prey and mentions the name of Allah, but misses it and hits another one. He (the Imam) said, ‘He can use it for food.’”
سَأَلْتُ الرِّضَا ع عَنْ طُرُوقِ الطَّيْرِ بِاللَّيْلِ فِي وَكْرِهَا فَقَالَ لَا بَأْسَ بِذَلِكَ[1]. - أَحْمَدُ بْنُ مُحَمَّدِ بْنِ عِيسَى عَنْ عَلِيِّ بْنِ أَحْمَدَ بْنِ أَشْيَمَ عَنْ صَفْوَانَ بْنِ يَحْيَى عَنْ أَبِي الْحَسَنِ الرِّضَا ع مِثْلَهُ.
قَالَ رَسُولُ اللَّهِ ص لَا تَأْتُوا الْفِرَاخَ فِي أَعْشَاشِهَا وَ لَا الطَّيْرَ فِي مَنَامِهِ حَتَّى يُصْبِحَ فَقَالَ لَهُ رَجُلٌ وَ مَا مَنَامُهُ يَا رَسُولَ اللَّهِ فَقَالَ اللَّيْلُ مَنَامُهُ فَلَا تَطْرُقْهُ فِي مَنَامِهِ حَتَّى يُصْبِحَ وَ لَا تَأْتُوا الْفَرْخَ فِي عُشِّهِ حَتَّى يَرِيشَ وَ يَطِيرَ فَإِذَا طَارَ فَأَوْتِرْ لَهُ قَوْسَكَ وَ انْصِبْ لَهُ فَخَّكَ.
“Abu ‘Abd Allah (a.s.), has said that the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has said, ‘Do not go to the baby birds in their nests at night or to the birds during their sleep [until the morning].’ A man then asked, ‘What is during their sle
نَهَى رَسُولُ اللَّهِ ص عَنْ إِتْيَانِ الطَّيْرِ بِاللَّيْلِ وَ قَالَ ع إِنَّ اللَّيْلَ أَمَانٌ لَهَا.
“Abu ‘Abd Allah (a.s.), has said that the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, prohibited hunting birds during the night, saying that the night is sanctuary for them.’”
سَأَلْتُهُ عَنْ صَيْدِ الْحِيتَانِ وَ إِنْ لَمْ يُسَمَّ عَلَيْهِ فَقَالَ لَا بَأْسَ بِهِ.
“I once asked abu ‘ Abd Allah (a.s.), about catching fish without a mention of the name of Allah. He (the Imam) said, ‘It is not unlawful.’”
لَا بَأْسَ بِهِ إِنْ كَانَ حَيّاً أَنْ يَأْخُذَهُ.
‘It is not unlawful if it is alive when he catches it.’”
سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ السَّمَكِ يُصَادُ ثُمَّ يُجْعَلُ فِي شَيْءٍ ثُمَّ يُعَادُ إِلَى الْمَاءِ فَيَمُوتُ فِيهِ فَقَالَ لَا تَأْكُلْهُ.
“I once asked abu ‘Abd Allah (a.s.), about fish which is caught, then placed in something but it returns into the water and dies in it. He (the Imam) said, ‘Do not use it for food.”’
أَنَّهُ سَأَلَ أَبَا عَبْدِ اللَّهِ ع عَنْ رَجُلٍ اصْطَادَ سَمَكَةً فَرَبَطَهَا بِخَيْطٍ وَ أَرْسَلَهَا فِي الْمَاءِ فَمَاتَتْ أَ تُؤْكَلُ قَالَ لَا.
“I once asked abu ‘Abd Allah (a.s.), about the case of a man who catches fish, then ties it to a string, then sends it in the water where it dies; if he can use it for food. He (the Imam) said, ‘No, he must not use it for food.’”
