الْمُدَبَّرُ مِنَ الثُّلُثِ وَ لِلرَّجُلِ أَنْ يَرْجِعَ فِي ثُلُثِهِ إِنْ كَانَ أَوْصَى فِي صِحَّةٍ أَوْ مَرَضٍ[5].

"A mudabbar (a slave promised freedom after the owner's death) is considered to be from the one-third (of the estate). A man has the right to retract from his bequest regarding this one-third, whether he made the will during his health or illness."

إِنْ كَانَ فِي مَرَضٍ فَالْعِتْقُ أَفْضَلُ لَهُ لِأَنَّهُ يُعْتِقُ اللَّهُ عَزَّ وَ جَلَّ بِكُلِّ عُضْوٍ مِنْهُ عُضْواً مِنَ النَّارِ وَ إِنْ كَانَ فِي حَالِ حُضُورِ الْمَوْتِ فَيَتْرُكُهُ مَمْلُوكاً أَفْضَلُ لَهُ مِنْ عِتْقِهِ.

Hadith.3560 - Muhammad ibn Isa al-Ubaydi narrated from al-Fadl ibn al-Mubarak: He wrote to Abu al-Hasan Ali ibn Muhammad (as) asking about a man who owns a slave, and the slave becomes ill. Is it better for the man to free him during his illness to gain a greater reward, or to leave him as a servant? Imam (as) replied:

لَا تَتَعَرَّضُوا لِلْحُقُوقِ- فَإِذَا لَزِمَتْكُمْ فَاصْبِرُوا لَهَا[5].

Hadith.3632 - Isma'il bin Jabir narrated from Abu Abdillah (as) that he said: "Do not expose yourselves to obligations, but if they become binding upon you, then be patient with them."

لَهُ سَلِّمْ ابْنَكَ مِنِّي سَنَةً بِزِيَادَةٍ هَلْ لَهُ الْخِيَارُ فِي ذَلِكَ وَ هَلْ يَجُوزُ لَهُ أَنْ يَفْسَخَ مَا وَافَقَ عَلَيْهِ الْأَوَّلُ أَمْ لَا فَكَتَبَ ع بِخَطِّهِ يَجِبُ عَلَيْهِ الْوَفَاءُ لِلْأَوَّلِ مَا لَمْ يَعْرِضْ لِابْنِهِ مَرَضٌ أَوْ ضَعْفٌ‌[3].

Hadith.3654 - Muhammad bin Isa bin Ubaid Al-Yaqtini wrote to Abu Al-Hasan Imam Ali bin Muhammad Al-Askari (as), asking: "A man entrusted his son to another man and handed him over for a year with a known wage to sew for him. Hadith.3660 - Muhammad bin Muslim asked Abu Ja'far Imam Muhammad ibn Ali Al-Baqir (as), about a man who prepares medicine for people and takes a fee for it. Imam (as) said: 'There is no harm in it.'

وَ قَالَ النَّبِيُّ ص لِرَجُلٍ‌[2] أَصْبَحْتَ صَائِماً قَالَ لَا قَالَ فَعُدْتَ مَرِيضاً قَالَ لَا قَالَ فَاتَّبَعْتَ جَنَازَةً قَالَ لَا قَالَ فَأَطْعَمْتَ مِسْكِيناً قَالَ لَا قَالَ فَارْجِعْ إِلَى أَهْلِكَ فَأَصِبْهُمْ فَإِنَّهُ مِنْكَ عَلَيْهِمْ صَدَقَةٌ[3].

سَمِعْتُهُ يَقُولُ‌ اللَّحْمُ يُنْبِتُ اللَّحْمَ وَ السَّمَكُ يُذِيبُ الْجَسَدَ وَ الدُّبَّاءُ يَزِيدُ فِي الدِّمَاغِ‌[4] وَ كَثْرَةُ أَكْلِ الْبَيْضِ يَزِيدُ فِي الْوَلَدِ وَ مَا اسْتَشْفَى مَرِيضٌ بِمِثْلِ الْعَسَلِ وَ مَنْ‌ أَدْخَلَ جَوْفَهُ لُقْمَةَ شَحْمٍ أَخْرَجَتْ مِثْلَهَا مِنَ الدَّاءِ.

Hadith.4235 - Musa ibn Bakr al-Wasiti narrated from Abu al-Hasan Imam Musa ibn Jafar Al-Kadhim (as) that he said: "Meat nourishes the flesh, and fish melts the body. عَجِبْتُ لِمَنْ يَحْتَمِي مِنَ الطَّعَامِ مَخَافَةَ الدَّاءِ كَيْفَ لَا يَحْتَمِي مِنَ الذُّنُوبِ مَخَافَةَ النَّارِ[5]

Hadith.4272 - The Messenger of Allah (swt) (peace be upon him and his family) said: "I am amazed at the one who abstains from food out of fear of illness, how does he not abstain from sins out of fear of the Fire?"

Hadith.4309 - Talhah ibn Zayd narrated from Imam Jafar ibn Muhammad Al-Sadiq (as) from his father, Imam Muhammad ibn Ali Al-Baqir (as), regarding a pregnant woman who drank medicine and caused a miscarriage. Imam (as) said: "She must offer expiation for it."

إِنَّ اللَّهَ عَزَّ وَ جَلَّ كَتَبَ عَلَى الرِّجَالِ الْجِهَادَ وَ عَلَى النِّسَاءِ الْجِهَادَ فَجِهَادُ الرَّجُلِ أَنْ يَبْذُلَ مَالَهُ وَ دَمَهُ حَتَّى يُقْتَلَ فِي سَبِيلِ اللَّهِ عَزَّ وَ جَلَّ وَ جِهَادُ الْمَرْأَةِ أَنْ تَصْبِرَ عَلَى مَا تَرَى مِنْ أَذَى زَوْجِهَا وَ غَيْرَتِهِ‌[2].

"Indeed, Allah (swt), the Mighty and Majestic, has ordained jihad upon men and jihad upon women. The jihad of a man is to spend his wealth and sacrifice his blood until he is killed in the way of Allah (swt), the Mighty and Majestic. إِنَّ رَجُلًا مِنَ الْأَنْصَارِ عَلَى عَهْدِ رَسُولِ اللَّهِ ص خَرَجَ فِي بَعْضِ حَوَائِجِهِ وَ عَهِدَ إِلَى امْرَأَتِهِ عَهْداً أَلَّا تَخْرُجَ مِنْ بَيْتِهَا حَتَّى يَقْدَمَ قَالَ وَ إِنَّ أَبَاهَا مَرِضَ فَبَعَثَتِ الْمَرْأَةُ إِلَى رَسُولِ اللَّهِ ص فَقَالَتْ إِنَّ زَوْجِي خَرَجَ وَ عَهِدَ إِلَيَّ أَنْ لَا أَخْرُجَ مِنْ بَيْتِي حَتَّى يَقْدَمَ وَ إِنَّ أَبِي مَرِيضٌ فَتَأْمُرُنِي أَنْ أَعُودَهُ فَقَالَ لَا اجْلِس

A man from the Ansar, during the time of the Messenger of Allah (swt) (peace and blessings be upon him and his family), went out for some errands and instructed his wife not to leave her house until he returned. عَلَيْكُمْ بِالْوُضَّاءِ[3] مِنَ الظُّئُورَةِ فَإِنَّ اللَّبَنَ يُعْدِي.

"Choose healthy wet nurses, for milk can transmit illness."

قَالَ عَلِيٌّ ع‌ فِي الْمَرَضِ يُصِيبُ الصَّبِيَّ إِنَّهُ كَفَّارَةٌ لِوَالِدَيْهِ.

Hadith.4694 - Imam Ali ibn Abi Talib (as) said: "When a child falls ill, it serves as an expiation for the sins of the parents."

سَمِعْتُ الْعَبْدَ الصَّالِحَ ع يَقُولُ‌ تُسْتَحَبُ‌

Hadith.4748 - Salih ibn Uqbah narrated that he heard the Righteous Servant (Imam Musa ibn Jafar Al-Kadhim (as)) say: "It is recommended for a boy to be lively and energetic in his childhood so that he may grow to be gentle and patient in his adulthood."

فِي خَبَرٍ آخَرَ أَنَّهُ إِنْ بَلَغَ بِهِ الْجُنُونُ مَبْلَغاً لَا يَعْرِفُ أَوْقَاتَ الصَّلَاةِ فُرِّقَ بَيْنَهُمَا فَإِنْ عَرَفَ أَوْقَاتَ الصَّلَاةِ فَلْتَصْبِرِ الْمَرْأَةُ مَعَهُ فَقَدْ بُلِيَتْ‌[2].

Hadith.4819 - And in another narration: "If his insanity reaches the point where he no longer recognizes the times of prayer, they are to be separated. However, if he still recognizes the times of prayer, the woman should remain patient with him, for she has been tested."

إِذَا أَرَادَ أَنْ يُوَاقِعَ امْرَأَتَهُ قُلْتُ فَإِنْ طَلَّقَهَا قَبْلَ أَنْ يُوَاقِعَهَا أَ عَلَيْهِ كَفَّارَةٌ فَقَالَ لَا سَقَطَتِ الْكَفَّارَةُ عَنْهُ قُلْتُ فَإِنْ صَامَ فَمَرِضَ فَأَفْطَرَ أَ يَسْتَقْبِلُ أَوْ يُتِمُّ مَا بَقِيَ عَلَيْهِ فَقَالَ إِنْ صَامَ شَهْراً ثُمَّ مَرِضَ اسْتَقْبَلَ فَإِنْ زَادَ عَلَى الشَّهْرِ يَوْماً أَوْ يَوْمَيْنِ‌ بَنَى عَلَيْهِ‌[1] قَالَ وَ قَالَ الْحُرُّ وَ الْمَمْلُوكُ سَوَاءٌ غَ

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ وَ هُوَ مَرِيضٌ فَقَالَ تَرِثُهُ فِي مَرَضِهِ مَا بَيْنَهُ وَ بَيْنَ سَنَةٍ إِنْ مَاتَ مِنْ مَرَضِهِ ذَلِكَ وَ تَعْتَدُّ مِنْ يَوْمَ طَلَّقَهَا عِدَّةَ الْمُطَلَّقَةِ ثُمَّ تَتَزَوَّجُ إِذَا انْقَضَتْ عِدَّتُهَا وَ تَرِثُهُ مَا بَيْنَهَا وَ بَيْنَ سَنَةٍ إِنْ مَاتَ فِي مَرَضِهِ ذَلِكَ فَإِنْ مَاتَ بَعْدَ مَا تَمْضِي سَنَةٌ فَلَيْسَ لَهَا مِيرَاثٌ‌[2].

I asked Abu Abdullah (as) about a man who divorced his wife while he was ill. Imam (as) said: "She inherits from him during his illness for up to a year if he dies from that illness. She observes the waiting period ('iddah) from the day he divorced her, following the waiting period of a divorced woman. After her waitin

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ الْمَرِيضِ يُطَلِّقُ امْرَأَتَهُ فِي تِلْكَ الْحَالِ قَالَ لَا وَ لَكِنْ لَهُ أَنْ يَتَزَوَّجَ إِنْ شَاءَ فَإِنْ دَخَلَ بِهَا وَرِثَتْهُ وَ إِنْ لَمْ يَدْخُلْ بِهَا فَنِكَاحُهُ بَاطِلٌ‌[1].

I asked Abu Abdullah (as) about a sick man who divorces his wife in that state (of illness). Imam (as) said: "No, but he may marry if he wishes. If he consummates the marriage, she will inherit from him. However, if he does not consummate the marriage, then his marriage is invalid."

إِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ تَطْلِيقَةً فِي مَرَضِهِ ثُمَّ مَكَثَ فِي مَرَضِهِ حَتَّى انْقَضَتْ عِدَّتُهَا ثُمَّ مَاتَ فِي ذَلِكَ الْمَرَضِ بَعْدَ انْقِضَاءِ الْعِدَّةِ فَإِنَّهَا تَرِثُهُ مَا لَمْ تَتَزَوَّجْ فَإِذَا كَانَتْ تَزَوَّجَتْ بَعْدَ انْقِضَاءِ الْعِدَّةِ فَإِنَّهَا لَا تَرِثُهُ‌[4].

"If a man divorces his wife with one divorce during his illness and remains in his illness until her waiting period ends, and then he dies from that illness after the completion of her waiting period, she will inherit from him as long as she has not remarried. فِي رِوَايَةِ سَمَاعَةَ قَالَ: سَأَلْتُهُ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ ثُمَّ إِنَّهُ مَاتَ‌ قَبْلَ أَنْ تَنْقَضِيَ عِدَّتُهَا قَالَ تَعْتَدُّ عِدَّةَ الْمُتَوَفَّى عَنْهَا زَوْجُهَا وَ لَهَا الْمِيرَاثُ‌[1].

Hadith.4878 - In a narration from Samaʿah, he said: I asked him about a man who divorced his wife, and then he died before her waiting period had ended. Imam (as) said: "She must observe the waiting period of a woman whose husband has passed away, and she is entitled to inherit from him."

فِي رَجُلٍ طَلَّقَ تَطْلِيقَتَيْنِ فِي صِحَّةٍ ثُمَّ طَلَّقَ التَّطْلِيقَةَ الثَّالِثَةَ وَ هُوَ مَرِيضٌ إِنَّهَا تَرِثُهُ مَا دَامَ فِي مَرَضِهِ وَ إِنْ كَانَ إِلَى سَنَةٍ[3].

Hadith.4879 - In a narration from Ibn Abi Umair through Aban, it is reported that Abu Abdullah (as) said: "Regarding a man who divorced his wife twice while in good health and then pronounced the third divorce while he was ill, she is entitled to inherit from him as long as he remains in his illness, even if it extends

لَيْسَ لِلْمَرِيضِ أَنْ يُطَلِّقَ امْرَأَتَهُ وَ لَهُ أَنْ يَتَزَوَّجَ‌[4].

Hadith.4880 - In a narration from Ibn Bukayr through Zurara, it is reported that Abu Abdullah (as) said: "A sick man does not have the right to divorce his wife, but he is permitted to marry."

سَأَلْتُهُ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ وَ هُوَ مَرِيضٌ فَقَالَ تَرِثُهُ مَا دَامَتْ فِي عِدَّتِهَا فَإِنْ طَلَّقَهَا فِي حَالِ الْإِضْرَارِ فَهِيَ تَرِثُهُ إِلَى سَنَةٍ[5] وَ إِنْ زَادَ عَلَى السَّنَةِ فِي عِدَّتِهَا[6] يَوْمٌ وَاحِدٌ لَمْ تَرِثْهُ‌[7].

Hadith.4882 - In a narration from Hammad through Al-Halabi, it is reported that Abu Abdullah (as) was asked about a man who was on his deathbed and divorced his wife. He was asked whether such a divorce was permissible. Imam (as) replied: "Yes, it is permissible. If he dies, she will inherit from him, but if she dies,

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنِ الْمَفْقُودِ كَيْفَ تَصْنَعُ امْرَأَتُهُ قَالَ مَا سَكَتَتْ عَنْهُ وَ صَبَرَتْ يُخَلَّى عَنْهَا وَ إِنْ هِيَ رَفَعَتْ أَمْرَهَا إِلَى الْوَالِي أَجَّلَهَا أَرْبَعَ سِنِينَ ثُمَّ يَكْتُبُ إِلَى الصُّقْعِ الَّذِي فُقِدَ فِيهِ‌[1] فَيُسْأَلُ عَنْهُ فَإِنْ خُبِّرَ عَنْهُ بِحَيَاةٍ صَبَرَتْ وَ إِنْ لَمْ يُخْبَرْ عَنْهُ بِحَيَاةٍ حَتَّى تَمْضِيَ الْأَرْبَعُ سِنِينَ- دُعِيَ وَلِيُّ الزَّ

إِنَّ عَبَّادَ الْمَكِّيِ‌[1] قَالَ قَالَ لِي سُفْيَانُ الثَّوْرِيُّ أَرَى لَكَ مِنْ أَبِي عَبْدِ اللَّهِ ع مَنْزِلَةً فَاسْأَلْهُ عَنْ رَجُلٍ زَنَى وَ هُوَ مَرِيضٌ فَإِنْ أُقِيمَ عَلَيْهِ الْحَدُّ خَافُوا أَنْ يَمُوتَ مَا تَقُولُ فِيهِ قَالَ فَسَأَلْتُهُ فَقَالَ لِي هَذِهِ الْمَسْأَلَةُ مِنْ تِلْقَاءِ نَفْسِكَ أَوْ أَمَرَكَ إِنْسَانٌ أَنْ تَسْأَلَ عَنْهَا فَقُلْتُ لَهُ إِنَّ سُفْيَانَ الثَّوْرِيَّ أَمَرَنِي أَنْ أَس

إِنْ كَانَ أَوْجَبَ عَلَى نَفْسِهِ الْحَدَّ وَ هُوَ صَحِيحٌ لَا عِلَّةَ بِهِ مِنْ ذَهَابِ عَقْلٍ أُقِيمَ عَلَيْهِ الْحَدُّ كَائِناً مَا كَانَ‌[2].

Hadith.5046 - In the narration reported by Al-Hasan ibn Mahbub from Ali ibn Riʾab from Abu Ubaydah from Abu Jafar (as), regarding a man upon whom a legal punishment (hadd) was due but he was not punished until he became mentally disturbed. وَ قَالَ الصَّادِقُ ع‌[1] شَارِبُ الْخَمْرِ إِنْ مَرِضَ فَلَا تَعُودُوهُ وَ إِنْ مَاتَ فَلَا تَشْهَدُوهُ وَ إِنْ شَهِدَ فَلَا تُزَكُّوهُ‌[2] وَ إِنْ خَطَبَ إِلَيْكُمْ فَلَا تُزَوِّجُوهُ فَإِنَّ مَنْ زَوَّجَ ابْنَتَهُ شَارِبَ الْخَمْرِ فَكَأَنَّمَا قَادَهَا إِلَى الزِّنَا وَ مَنْ زَوَّجَ ابْنَتَهُ مُخَالِفاً لَهُ عَلَى دِينِهِ فَقَدْ قَطَعَ رَحِمَهَا[3] وَ مَنِ ائْتَمَنَ شَارِبَ الْخَمْرِ لَمْ يَكُنْ لَهُ عَلَى اللَّه

Hadith.5321 - In the narration by Al-Hasan ibn Mahbub from Ali ibn Riʾab from Abu Ubaydah from Abu Abdullah (as) regarding a woman who drank medicine while she was pregnant to abort her child and then miscarried. سَأَلَهُ بَعْضُ آلِ زُرَارَةَ عَنْ رَجُلٍ قَطَعَ لِسَانَ رَجُلٍ أَخْرَسَ فَقَالَ إِنْ كَانَ وَلَدَتْهُ أُمُّهُ وَ هُوَ أَخْرَسُ فَعَلَيْهِ الدِّيَةُ[4] وَ إِنْ كَانَ لِسَانُهُ ذَهَبَ بِوَجَعٍ أَوْ آفَةٍ بَعْدَ مَا كَانَ يَتَكَلَّمُ فَإِنَّ عَلَى الَّذِي قَطَعَ ثُلُثَ دِيَةِ لِسَانِهِ.

Hadith.5328 - Al-Hasan ibn Mahbub narrated from Hisham ibn Salim from Abu Baṣir from Abu Jafar Imam Muhammad ibn Ali Al-Baqir (as) that someone from the family of Zurarah asked Imam (as) about a man who cut off the tongue of a mute person. قُلْتُ لِأَبِي الْحَسَنِ ع الْمَرْأَةُ تَخَافُ الْحَبَلَ فَتَشْرَبُ الدَّوَاءَ فَتُلْقِي مَا فِي بَطْنِهَا فَقَالَ لَا فَقُلْتُ إِنَّمَا هُوَ نُطْفَةٌ قَالَ إِنَّ أَوَّلَ مَا يُخْلَقُ نُطْفَةٌ[6].

I asked Abu Al-Hasan (as) about a woman who fears pregnancy and drinks medicine to cause a miscarriage. Imam (as) replied: "No." I said: "It is only a drop of fluid (nutfah)." Imam (as) said: "Indeed, the first stage of creation is a drop of fluid (nutfah)."

إِذَا أَبَانَ بِهِ فَهُوَ جَائِزٌ وَ إِنْ أَوْصَى بِهِ فَمِنَ الثُّلُثِ‌[6].

سَمِعْتُ أَبَا عَبْدِ اللَّهِ ع يَقُولُ‌ لِلْمُوصِي أَنْ يَرْجِعَ فِي وَصِيَّتِهِ إِنْ كَانَ فِي صِحَّةٍ أَوْ مَرَضٍ‌[3].

I heard Abu Abdullah Imam Jafar ibn Muhammad Al-Sadiq (as) say: "The one making a will has the right to revoke it, whether he is in good health or ill."

أَبَا عَبْدِ اللَّهِ ع عَنْ رَجُلٍ أَقَرَّ لِوَارِثٍ لَهُ وَ هُوَ مَرِيضٌ بِدَيْنٍ عَلَيْهِ فَقَالَ‌ يَجُوزُ إِذَا كَانَ الَّذِي أَقَرَّ بِهِ دُونَ الثُّلُثِ‌[1].

I asked Abu Abdullah (as), about a man who, while ill and in debt, acknowledged a right for one of his heirs. Imam (as) said: "It is permissible if what he acknowledged is less than one-third (of his wealth)."

لَهُ الرَّجُلُ يُقِرُّ لِوَارِثٍ بِدَيْنٍ عَلَيْهِ فَقَالَ يَجُوزُ إِذَا كَانَ مَلِيّاً[2].

'I asked Imam (as) about a man who acknowledges a debt to one of his heirs.' Imam (as) said: "It is permissible if he is solvent (financially capable)."

أَبَا عَبْدِ اللَّهِ ع عَنْ رَجُلٍ أَوْصَى لِبَعْضِ وَرَثَتِهِ بِأَنَّ لَهُ عَلَيْهِ دَيْناً فَقَالَ إِنْ كَانَ الْمَيِّتُ مَرْضِيّاً فَأَعْطِهِ الَّذِي أَوْصَى لَهُ‌[3].

'I asked Abu Abdullah (as), about a man who, in his will, acknowledged a debt to one of his heirs.' Imam (as) said: "If the deceased was in a sound state of health, then give him what was bequeathed to him."

أَبَا عَبْدِ اللَّهِ ع عَنِ امْرَأَةٍ اسْتَوْدَعَتْ رَجُلًا مَالًا فَلَمَّا حَضَرَهَا الْمَوْتُ قَالَتْ لَهُ إِنَّ الْمَالَ الَّذِي دَفَعْتُهُ إِلَيْكَ لِفُلَانَةَ وَ مَاتَتِ الْمَرْأَةُ فَأَتَى أَوْلِيَاؤُهَا الرَّجُلَ وَ قَالُوا إِنَّهُ كَانَ لِصَاحِبَتِنَا مَالٌ لَا نَرَاهُ إِلَّا عِنْدَكَ فَاحْلِفْ لَنَا مَا قِبَلَكَ شَيْ‌ءٌ أَ فَيَحْلِفُ لَهُمْ فَقَالَ إِنْ كَانَتْ مَأْمُونَةً عِنْدَهُ فَلْيَحْلِفْ وَ إِنْ كَانَ

I asked Abu Abdullah (as), about a woman who entrusted a man with some wealth. When death approached her, she said to him, "The wealth I gave you belongs to so-and-so," and then the woman passed away. Her heirs came to the man and said: "Our relative had wealth, and we believe it is with you. Swear to us that you have

وَ رَوَى الْحَسَنُ بْنُ عَلِيٍّ الْوَشَّاءُ عَنْ عَبْدِ اللَّهِ بْنِ سِنَانٍ عَنْ عُمَرَ بْنِ يَزِيدَ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ‌ مَرِضَ عَلِيُّ بْنُ الْحُسَيْنِ ع ثَلَاثَ مَرَضَاتٍ فِي كُلِّ مَرْضَةٍ يُوصِي بِوَصِيَّةٍ فَإِذَا أَفَاقَ أَمْضَى وَصِيَّتَهُ.

"Imam Ali ibn Al-Hussain (as), fell ill three times, and in each illness, he would make a will. When he recovered, he would carry out his will."

إِذَا دَخَلَ بِهَا فَمَاتَ فِي مَرَضِهِ وَرِثَتْهُ وَ إِنْ لَمْ يَدْخُلْ بِهَا لَمْ تَرِثْهُ وَ نِكَاحُهُ بَاطِلٌ‌[1].

I asked Abu Abdullah (as) about a man who married during his illness. Imam (as) said: "If he consummated the marriage with her and then died during his illness, she inherits from him. However, if he did not consummate the marriage with her, she does not inherit from him, and the marriage is invalid."

فَإِنْ طَالَ بِهِ الْمَرَضُ قَالَ تَرِثُهُ مَا بَيْنَهُ وَ بَيْنَ سَنَةٍ[3].

"If a man divorces his wife while he is ill, she inherits from him as long as he remains in that illness, even if her waiting period (iddah) has ended - unless he recovers from his illness." I asked: "What if his illness lasts for a long time?" Imam (as) replied: "She inherits from him for up to one year."

نَعَمْ وَ هِيَ تَرِثُهُ وَ إِنْ مَاتَتْ لَمْ يَرِثْهَا[4].

Hadith.5669 - Hammad narrated from Al-Halabi, from Abu Abdullah (as), who was asked about a man who is on his deathbed and divorces his wife - whether his divorce is valid. Imam (as) said: "Yes, it is valid, and she will inherit from him. However, if she dies, he does not inherit from her."

هُوَ الْإِضْرَارُ[1] وَ مَعْنَى الْإِضْرَارِ مَنْعُهُ إِيَّاهَا مِيرَاثَهَا مِنْهُ فَأُلْزِمَ الْمِيرَاثَ عُقُوبَةً.

أَبَا جَعْفَرٍ ع- عَنِ امْرَأَةٍ شَرِبَتْ دَوَاءً عَمْداً وَ هِيَ حَامِلٌ وَ لَمْ تُعْلِمْ بِذَلِكَ زَوْجَهَا فَأَلْقَتْ وَلَدَهَا فَقَالَ إِنْ كَانَ لَهُ عَظْمٌ قَدْ نَبَتَ عَلَيْهِ اللَّحْمُ فَعَلَيْهَا دِيَةٌ تُسَلِّمُهَا إِلَى أَبِيهِ وَ إِنْ كَانَ عَلَقَةً أَوْ مُضْغَةً فَإِنَّ عَلَيْهَا أَرْبَعِينَ دِينَاراً أَوْ غُرَّةً تُؤَدِّيهَا إِلَى أَبِيهِ فَقُلْتُ لَهُ فَهِيَ لَا تَرِثُ وَلَدَهَا مِنْ دِيَتِهِ مَعَ أَبِ
