وَ النَّبَّاشُ إِذَا كَانَ مَعْرُوفاً بِذَلِكَ قُطِعَ[2].

وَ رُوِيَ أَنَّ عَلِيّاً ع قَطَعَ نَبَّاشَ الْقَبْرِ فَقِيلَ لَهُ أَ تَقْطَعُ فِي الْمَوْتَى فَقَالَ إِنَّا لَنَقْطَعُ لِأَمْوَاتِنَا كَمَا نَقْطَعُ لِأَحْيَائِنَا[3].
Hadith.5119 - It has been narrated that Imam Ali ibn Abi Talib (as) ordered the hand of a grave robber to be cut off. Imam (as) was asked: "Do you cut off (the hand) for stealing from the dead?" Imam (as) replied: "We cut for our dead just as we cut for our living."
وَ رُوِيَ: "أَنَّ أَمِيرَ اَلْمُؤْمِنِينَ عَلَيْهِ اَلسَّلاَمُ أُتِيَ بِنَبَّاشٍ فَأَخَذَ بِشَعْرِهِ وَ جَلَدَ بِهِ اَلْأَرْضَ ثُمَّ قَالَ "طَئُوا عَلَيْهِ عِبَادَ اَللَّهِ" فَوُطِئَ حَتَّى مَاتَ".
Hadith.5120 - It has been narrated that Commander of the Faithful (as) was presented with a grave robber. Imam (as) grabbed him by his hair, struck him against the ground, and then said: "Step on him, O' servants of Allah (swt)." So, the people trampled him until he died.
وَ سُئِلَ الصَّادِقُ ع عَنْ قَوْلِ اللَّهِ عَزَّ وَ جَلَ إِنَّما جَزاءُ الَّذِينَ

Hadith.5123 - In the narration of Al-Sakuni from Imam Jafar ibn Muhammad Al-Sadiq (as) from his father, Imam Muhammad ibn Ali Al-Baqir (as), it is reported: "Indeed, Imam Ali ibn Abi Talib (as) crucified a man in Al-Hirah for three days. Then on the fourth day, Imam (as) took him down, prayed over him, and buried him."
مَنْ حَمَلَ السِّلَاحَ بِاللَّيْلِ فَهُوَ مُحَارِبٌ إِلَّا أَنْ يَكُونَ رَجُلًا لَيْسَ مِنْ أَهْلِ الرِّيبَةِ[5].
"Whoever carries a weapon at night is considered a highway robber (muharib), unless he is a man who is not known for suspicion or wrongdoing."
قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع رَجُلٌ يَخْرُجُ مِنْ مَنْزِلِهِ يُرِيدُ الْمَسْجِدَ أَوْ يُرِيدُ الْحَاجَةَ فَيَلْقَاهُ رَجُلٌ أَوْ يَسْتَقْبِلُهُ فَيَضْرِبُهُ وَ يَأْخُذُ ثَوْبَهُ قَالَ أَيَّ شَيْءٍ يَقُولُ فِيهِ مَنْ قِبَلَكُمْ قَالَ قُلْتُ يَقُولُونَ هَذِهِ دَغَارَةٌ مُعْلَنَةٌ[6] وَ إِنَّمَا الْمُحَارِبُ فِي قُرًى مُشْرِكِيَّةٍ[7] فَقَالَ
I asked Abu Abdullah (as) about a man who leaves his house intending to go to the mosque or fulfill a need and is met or confronted by another man who strikes him and takes his garment. Hadith.5128 - Ishaq ibn Ammar narrated from Abu Abdullah (as) regarding a man who stole a cluster of dates from an orchard worth two dirhams. Imam (as) said: "His hand is to be cut off for that."
الْعَبْدُ إِذَا أَقَرَّ عَلَى نَفْسِهِ عِنْدَ الْإِمَامِ مَرَّةً أَنَّهُ سَرَقَ قَطَعَهُ وَ الْأَمَةُ إِذَا أَقَرَّتْ عَلَى نَفْسِهَا عِنْدَ الْإِمَامِ بِالسَّرِقَةِ قَطَعَهَا[2].
"If a male slave confesses to theft once before the Imam, his hand is to be cut off. Likewise, if a female slave confesses to theft before the Imam, her hand is to be cut off."
سَمِعْتُ أَبَا عَبْدِ اللَّهِ ع يَقُولُ إِذَا أَقَرَّ الْمَمْلُوكُ عَلَى نَفْسِهِ بِالسَّرِقَةِ لَمْ يُقْطَعْ وَ إِنْ شَهِدَ عَلَيْهِ شَاهِدَانِ قُطِعَ.
I heard Abu Abdullah (as) say: "If a slave confesses to theft, his hand is not to be cut off. However, if two witnesses testify against him, his hand is to be cut off."
سُئِلَ أَحَدُهُمَا ع عَنْ حَدِّ الْأَخْرَسِ وَ الْأَصَمِّ وَ الْأَعْمَى قَالَ عَلَيْهِمُ الْحُدُودُ إِذَا كَانُوا يَعْقِلُونَ مَا يَأْتُونَ.
Hadith.5131 - Yunus narrated from Ishaq ibn Ammar who said that one of the two Imams (peace be upon them) was asked about the legal punishments (hudud) for a mute, a deaf person, and a blind person. Imam (as) said: "The legal punishments apply to them if they comprehend what they are doing."
رَوَى إِسْحَاقُ بْنُ عَمَّارٍ وَ سَمَاعَةُ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ:
I asked Imam - "What is the punishment for one who consumes usury after clear evidence (has been established)?" Imam (as) replied: "He is to be disciplined. If he returns to it, he is disciplined again. If he repeats it a third time, he is to be killed."
آكِلُ الْمَيْتَةِ وَ الدَّمِ وَ لَحْمِ الْخِنْزِيرِ عَلَيْهِ أَدَبٌ فَإِنْ عَادَ أُدِّبَ قُلْتُ فَإِنْ عَادَ قَالَ يُؤَدَّبُ وَ لَيْسَ عَلَيْهِ قَتْلٌ[1].
"One who consumes carrion, blood, or pork is to be disciplined. If he returns to it, he is disciplined again." I asked: "And if he does it again?" Imam (as) replied: "He is to be disciplined, but there is no execution upon him."
أَيُّمَا رَجُلٍ اجْتَمَعَتْ عَلَيْهِ حُدُودٌ فِيهَا الْقَتْلُ يُبْدَأُ بِالْحُدُودِ الَّتِي هِيَ دُونَ الْقَتْلِ ثُمَّ يُقْتَلُ بَعْدَ ذَلِكَ[2].
"Any man upon whom multiple legal punishments (hudud) have been established, and among them is the punishment of death, the lesser punishments are to be carried out first, and then he is to be executed afterward."

I asked Abu Abdullah (as), "Who is responsible for carrying out the legal punishments (hudud) -the ruler or the judge?" Imam (as) replied: "The implementation of the legal punishments belongs to the one who holds the authority of judgment."
وَ رُوِيَ أَنَّ رَجُلًا جَاءَ بِرَجُلٍ إِلَى أَمِيرِ الْمُؤْمِنِينَ ع فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ إِنَّ هَذَا زَعَمَ أَنَّهُ احْتَلَمَ بِأُمِّي فَقَالَ إِنَّ الْحُلُمَ بِمَنْزِلَةِ الظِّلِّ فَإِنْ شِئْتَ جَلَدْتُ لَكَ ظِلَّهُ ثُمَّ قَالَ ع لَكِنِّي أُوجِعُهُ لِئَلَّا يَعُودَ يُؤْذِي الْمُسْلِمِينَ[2].
Hadith.5136 - It has been narrated that a man brought another man to Commander of the Faithful (as) and said: "O' Commander of the Faithful, this man claimed that he had a wet dream involving my mother." Commander of the Faithful (as) replied: "A dream is like a shadow; if you wish, I will flog his shadow for you." The
رُوِيَ أَنَّهُ دَنَا مِنْ أَمِيرِ الْمُؤْمِنِينَ ع صَبِيَّانِ بِيَدِهِمَا لَوْحَانِ فَقَالا يَا أَمِيرَ الْمُؤْمِنِينَ خَايِرْ بَيْنَنَا قَالَ أَمِيرُ الْمُؤْمِنِينَ ع إِنَّ الْجَوْرَ فِي هَذَا كَالْجَوْرِ فِي الْأَحْكَامِ أَبْلِغَا مُؤَدِّبَكُمَا عَنِّي أَنَّهُ إِنْ ضَرَبَكُمَا فَوْقَ ثَلَاثٍ كَانَ ذَلِكَ قِصَاصاً يَوْمَ الْقِيَامَةِ[3].
Hadith.5137 - It has been narrated that two boys approached Commander of the Faithful (as) holding their wooden tablets and said: "O' Commander of the Faithful, judge between us." أَصْحَابُ الْكَبَائِرِ كُلِّهَا إِذَا أُقِيمَ عَلَيْهِمُ الْحَدُّ مَرَّتَيْنِ قُتِلُوا فِي الثَّالِثَةِ[4].
"All those who commit major sins (kabaʾir), if the legal punishment (Hadd) is carried out on them twice, they are to be executed on the third offense."
مَنْ ضَرَبْنَاهُ حَدّاً مِنْ حُدُودِ اللَّهِ فَمَاتَ فَلَا دِيَةَ لَهُ عَلَيْنَا وَ مَنْ ضَرَبْنَاهُ حَدّاً مِنْ حُدُودِ النَّاسِ فَمَاتَ فَإِنَّ دِيَتَهُ عَلَيْنَا[5]
جَاءَ رَجُلٌ إِلَى رَسُولِ اللَّهِ ص فَقَالَ إِنَّ أُمِّي لَا تَدْفَعُ يَدَ لَامِسٍ[6] قَالَ فَاحْبِسْهَا قَالَ قَدْ فَعَلْتُ قَالَ فَامْنَعْ مَنْ يَدْخُلُ عَلَيْهَا قَالَ قَدْ فَعَلْتُ قَالَ فَقَيِّدْهَا فَإِنَّكَ لَا تَبَرُّهَا بِشَيْءٍ أَفْضَلَ مِنْ أَنْ تَمْنَعَهَا مِنْ مَحَارِمِ اللَّهِ عَزَّ وَ جَلَ[1].
A man came to the Messenger of Allah (swt) (peace be upon him and his family) and said: "My mother does not resist the hand of one who touches her." The Prophet (peace be upon him and his family) said: "Then confine her." The man replied: "I have done that." The Prophet (sw) said: "Then prevent anyone from entering upo
لَا يُعْفَى عَنِ الْحُدُودِ الَّتِي لِلَّهِ عَزَّ وَ جَلَّ دُونَ الْإِمَامِ فَأَمَّا مَا كَانَ مِنْ حَقِّ النَّاسِ فِي حَدٍّ فَلَا بَأْسَ أَنْ يُعْفَى عَنْهُ دُونَ الْإِمَامِ[2].
"The legal punishments (hudud) that are the rights of Allah (swt), the Mighty and Majestic, cannot be pardoned except by the Imam. However, when it comes to the rights of people in a legal punishment, there is no harm if it is pardoned without the Imam's involvement."
لِامْرَأَةٍ يَا زَانِيَةُ فَقَالَتْ أَنْتَ أَزْنَى مِنِّي قَالَ عَلَيْهَا الْحَدُّ فِيمَا قَذَفَتْهُ بِهِ[3] وَ أَمَّا فِي إِقْرَارِهَا عَلَى نَفْسِهَا فَلَا تُحَدُّ حَتَّى تُقِرَّ بِذَلِكَ عِنْدَ الْإِمَامِ أَرْبَعَ مَرَّاتٍ.

لَا يَحِلُّ لِوَالٍ يُؤْمِنُ بِاللَّهِ وَ الْيَوْمِ الْآخِرِ أَنْ يَجْلِدَ أَكْثَرَ مِنْ عَشَرَةِ أَسْوَاطٍ إِلَّا فِي حَدٍّ[4]. وَ أُذِنَ فِي أَدَبِ الْمَمْلُوكِ مِنْ ثَلَاثَةٍ إِلَى خَمْسَةٍ[5] وَ مَنْ ضَرَبَ مَمْلُوكَهُ حَدّاً لَمْ يَجِبْ عَلَيْهِ لَمْ يَكُنْ لَهُ كَفَّارَةٌ إِلَّا عِتْقُهُ[6]
لَا يُقْطَعُ السَّارِقُ فِي سَنَةِ الْمَحْقِ[1] فِي شَيْءٍ يُؤْكَلُ مِثْلِ الْخُبْزِ وَ اللَّحْمِ وَ الْقِثَّاءِ.
Hadith.5144 - In the narration of Ziyad ibn Marwan Al-Qandi from someone who reported from Abu Abdullah (as), he said: "The hand of a thief is not to be cut off during a year of famine for stealing anything edible, such as bread, meat, or cucumbers."
كُنْتُ عِنْدَ أَبِي جَعْفَرٍ ع وَ جَاءَهُ كِتَابُ هِشَامِ بْنِ عَبْدِ الْمَلِكِ فِي رَجُلٍ نَبَشَ امْرَأَةً فَسَلَبَهَا ثِيَابَهَا وَ نَكَحَهَا[2] فَإِنَّ النَّاسَ قَدِ اخْتَلَفُوا عَلَيْنَا هَاهُنَا طَائِفَةٌ قَالُوا اقْتُلُوهُ وَ طَائِفَةٌ قَالُوا أَحْرِقُوهُ فَكَتَبَ ع إِلَيْهِ أَنَّ حُرْمَةَ الْمَيِّتِ كَحُرْمَةِ الْحَيِّ حَدُّهُ أَنْ تُقْطَعَ يَدُهُ لِنَبْشِهِ وَ سَلْبِهِ الثِّيَابَ[3] وَ يُقَامَ عَلَيْهِ الْحَ

Hadith.5149 - Commander of the Faithful (as) delivered a sermon to the people and said: "Indeed, Allah (swt), the Blessed and Exalted, has set boundaries, so do not transgress them. He (swt) has made obligations, so do not neglect them. And He (swt) has remained silent on certain matters - not out of forgetfulness - so
حَدَّثَنِي الْحُسَيْنُ الرَّوَّاسِيُّ عَنِ ابْنِ أَبِي عُمَيْرٍ الطَّبِيبِ[4] قَالَ: عَرَضْتُ هَذِهِ الرِّوَايَةَ عَلَى أَبِي عَبْدِ اللَّهِ ع فَقَالَ نَعَمْ هِيَ حَقٌّ وَ قَدْ كَانَ أَمِيرُ الْمُؤْمِنِينَ ع يَأْمُرُ عُمَّالَهُ بِذَلِكَ- قَالَ أَفْتَى ع فِي كُلِّ عَظْمٍ لَهُ مُخٌّ فَرِيضَةً مُسَمَّاةً إِذَا كُسِرَ فَجُبِرَ عَلَى غَيْرِ عَثْمٍ[1] وَ لَا عَيْبٍ جَعَلَ فَرِيضَةَ الدِّيَةِ سِتَّةَ أَجْزَاءٍ[2] وَ جَعَل
I presented this narration to Abu Abdullah (as), and Imam(as) said: "Yes, it is true. Indeed, the Commander of the Faithful (as) used to instruct his officials with this." He said: "Imam (as) gave a ruling that for every bone that contains marrow, there is a specified obligatory compensation if it is broken and healed
إِنَّ رَسُولَ اللَّهِ ص وَقَفَ بِمِنًى حِينَ قَضَى مَنَاسِكَهُ فِي حَجَّةِ الْوَدَاعِ فَقَالَ أَيُّهَا النَّاسُ اسْمَعُوا مَا أَقُولُ لَكُمْ وَ اعْقِلُوهُ فَإِنِّي لَا أَدْرِي لَعَلِّي لَا أَلْقَاكُمْ فِي هَذَا الْمَوْقِفِ بَعْدَ عَامِنَا هَذَا ثُمَّ قَالَ أَيُّ يَوْمٍ أَعْظَمُ حُرْمَةً قَالُوا هَذَا الْيَوْمُ قَالَ فَأَيُّ شَهْرٍ أَعْظَمُ حُرْمَةً قَالُوا هَذَا الشَّهْرُ قَالَ فَأَيُّ بَلْدَةٍ أَعْظَمُ حُرْمَةً قَا
"Indeed, the Messenger of Allah (swt) (peace be upon him and his family) stood at Mina after completing his rituals during the Farewell Pilgrimage and said: 'O' people, listen to what I (sw) say to you and understand it, for I (sw) do not know, perhaps I (sw) will not meet you again in this place after this year.' Then
قَالَ رَسُولُ اللَّهِ ص لَا يَغُرَّنَّكُمْ رَحْبُ الذِّرَاعَيْنِ بِالدَّمِ فَإِنَّ لَهُ عِنْدَ اللَّهِ قَاتِلًا لَا يَمُوتُ[1] قَالُوا يَا رَسُولَ اللَّهِ وَ مَا قَاتِلٌ لَا يَمُوتُ قَالَ النَّارُ.
'The Messenger of Allah (swt) said: "Do not be deceived by one who freely sheds blood, for indeed, he has a killer appointed for him by Allah (swt) who does not die." They asked: "O' Messenger of Allah (swt), and what is the killer that does not die?" Prophet (sw) said: "The Fire."
لَا يَزَالُ الْمُؤْمِنُ فِي فُسْحَةٍ مِنْ دِينِهِ مَا لَمْ يُصِبْ دَماً حَرَاماً وَ قَالَ لَا يُوَفَّقُ قَاتِلُ الْمُؤْمِنِ مُتَعَمِّداً لِلتَّوْبَةِ.
"A believer remains within the bounds of his faith as long as he does not commit unlawful killing." Imam (as) also said: "One who intentionally kills a believer is not granted success in repentance."
يَجِيءُ يَوْمَ الْقِيَامَةِ رَجُلٌ إِلَى رَجُلٍ حَتَّى يُلَطِّخَهُ بِالدَّمِ وَ النَّاسُ فِي الْحِسَابِ فَيَقُولُ يَا عَبْدَ اللَّهِ مَا لِي وَ لَكَ فَيَقُولُ أَعَنْتَ عَلَيَّ يَوْمَ كَذَا وَ كَذَا بِكَلِمَةٍ فَقُتِلْتُ[2].
"On the Day of Judgment, a man will approach another man and smear him with blood while the people are being held accountable. The (other) man will say, 'O' servant of Allah (swt), what do I have to do with you?' The man will reply: 'Did you not assist in my killing on such and such a day with a single word, and thus I
لَوْ أَنَّ رَجُلًا ضَرَبَ رَجُلًا سَوْطاً لَضَرَبَهُ اللَّهُ سَوْطاً مِنَ النَّارِ.
Hadith.5155 - In the narration of Al-Alaa from Al-Thumali, that Imam (as) said: "If a man were to strike another man with a whip, Allah (swt) would strike him with a whip of fire."
لَعَنَ رَسُولُ اللَّهِ ص مَنْ أَحْدَثَ بِالْمَدِينَةِ حَدَثاً أَوْ آوَى مُحْدِثاً- قُلْتُ وَ مَا ذَلِكَ الْحَدَثُ قَالَ الْقَتْلُ[1].
"The Messenger of Allah (swt) (peace be upon him and his family) cursed the one who commits an offense in Medina or shelters an offender." I asked: "What is this offense?" Imam (as) said: "It is killing."
مَنْ أَعَانَ عَلَى مُؤْمِنٍ بِشَطْرِ كَلِمَةٍ جَاءَ يَوْمَ الْقِيَامَةِ وَ بَيْنَ عَيْنَيْهِ مَكْتُوبٌ آيِسٌ مِنْ رَحْمَةِ اللَّهِ[2].
"Whoever assists in harming a believer with even half a word will come on the Day of Judgment with the words 'Despairing of the mercy of Allah (swt)' written between his eyes."
قَالَ لِي أَبُو عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ : "وُجِدَ فِي ذُؤَابَةِ سَيْفِ رَسُولِ اَللَّهِ صَلَّى اَللَّهُ عَلَيْهِ وَ آلِهِ صَحِيفَةٌ فَإِذَا فِيهَا مَكْتُوبٌ " "بِسْمِ اَللّٰهِ اَلرَّحْمٰنِ اَلرَّحِيمِ" إِنَّ أَعْتَى اَلنَّاسِ عَلَى اَللَّهِ يَوْمَ اَلْقِيَامَةِ مَنْ قَتَلَ غَيْرَ قَاتِلِهِ وَ ضَرَبَ غَيْرَ ضَارِبِهِ وَ مَنْ تَوَلَّى غَيْرَ مَوَالِيهِ فَهُوَ كَافِرٌ بِمَا أَنْزَلَ اَللَّهُ عَلَى مُحَمَّدٍ
Abu Abdullah (as) said to me: "A scroll was found in the hilt of the sword of Messenger of Allah (swt) (peace be upon him and his family), and it was written in it: In the Name of Allah (swt), the Most Gracious, the Most Merciful. Verily, the most defiant of people against Allah (swt) on the Day of Judgment is the one
هُوَ وَادٍ فِي جَهَنَّمَ لَوْ قَتَلَ النَّاسَ جَمِيعاً كَانَ فِيهِ وَ لَوْ قَتَلَ نَفْساً وَاحِدَةً كَانَ فِيهِ.
Hadith.5159 - It is narrated from Hanan ibn Sadir from Abu Abdullah (as) regarding the saying of Allah (swt), the Almighty and Majestic: "Whoever kills a soul without [the soul having killed] another soul or [without causing] corruption on the earth, it is as if he had killed all mankind" (Surah Al-Ma'idah 5:32). Hadith.5160 - It has been narrated: "A person who commits murder will be placed in a specific location in Hell, where the severity of punishment for its inhabitants reaches its peak. قَالَ رَسُولُ اللَّهِ ص مَنْ قُتِلَ دُونَ مَالِهِ[1] فَهُوَ شَهِيدٌ قَالَ وَ قَالَ لَوْ كُنْتُ أَنَا لَتَرَكْتُ الْمَالَ وَ لَمْ أُقَاتِلْ[2].
"The Messenger of Allah (swt) (peace be upon him and his family) said: 'Whoever is killed defending his wealth is a martyr.'" Imam (as) also said: "If it were me, I would have abandoned the wealth and not fought."
قُلْتُ لِأَبِي عَبْدِ اللَّهِ ع رَجُلٌ قَتَلَ رَجُلًا مَا تَوْبَتُهُ فَقَالَ يُمَكِّنُ مِنْ نَفْسِهِ قُلْتُ يَخَافُ أَنْ يَقْتُلُوهُ قَالَ فَلْيُعْطِهِمُ الدِّيَةَ قُلْتُ يَخَافُ أَنْ يَعْلَمُوا بِذَلِكَ قَالَ فَلْيَتَزَوَّجْ إِلَيْهِمُ امْرَأَةً قُلْتُ يَخَافُ أَنْ تُطْلِعَهُمْ عَلَى ذَلِكَ قَالَ فَلْيَنْظُرْ إِلَى الدِّيَةِ فَيَجْعَلُهَا صُرَراً ثُمَّ لْيَنْظُرْ مَوَاقِيتَ الصَّلَاةِ فَلْيُلْقِهَا فِي دَارِهِمْ[4]
I asked Abu Abdullah (as): "A man has killed another man; what is his repentance?" Imam (as) replied: "He should surrender himself." I said: "He fears they will kill him." Imam (as) said: "Then he should give them the blood money (diyyah)." I said: "He fears they will find out." Imam (as) said: "Then he should marry a
سَمِعْتُ أَبَا عَبْدِ اللَّهِ ع يَقُولُ مَنْ قَتَلَ نَفْسَهُ مُتَعَمِّداً فَهُوَ فِي نَارِ جَهَنَّمَ خَالِداً فِيهَا[5].
"I heard Abu Abdullah (as) say, 'Whoever intentionally kills themselves will be in the Fire of Hell, abiding therein forever.'"
سُئِلَ عَنِ الْمُؤْمِنِ يَقْتُلُ الْمُؤْمِنَ مُتَعَمِّداً لَهُ تَوْبَةٌ فَقَالَ إِنْ كَانَ قَتَلَهُ لِإِيمَانِهِ فَلَا تَوْبَةَ لَهُ وَ إِنْ كَانَ قَتَلَهُ لِغَضَبٍ أَوْ لِسَبَبِ شَيْءٍ مِنْ أَمْرِ الدُّنْيَا فَإِنَّ تَوْبَتَهُ أَنْ يُقَادَ مِنْهُ وَ إِنْ لَمْ يَكُنْ عَلِمَ بِهِ أَحَدٌ انْطَلَقَ إِلَى أَوْلِيَاءِ الْمَقْتُولِ فَأَقَرَّ عِنْدَهُمْ بِقَتْلِ صَاحِبِهِمْ فَإِنْ عَفَوْا عَنْهُ فَلَمْ يَقْتُلُوهُ أَعْطَاه

يُقَالُ لَهُ مُتْ أَيَّ مِيتَةٍ شِئْتَ إِنْ شِئْتَ يَهُودِيّاً وَ إِنْ شِئْتَ نَصْرَانِيّاً وَ إِنْ شِئْتَ مَجُوسِيّاً.
قَالَ رَسُولُ اللَّهِ ص أَوَّلُ مَا يَحْكُمُ اللَّهُ عَزَّ وَ جَلَّ فِيهِ- يَوْمَ الْقِيَامَةِ الدِّمَاءُ فَيُوقَفُ ابْنَا آدَمَ ع فَيُفْصَلُ بَيْنَهُمَا ثُمَّ الَّذِينَ يَلُونَهُمَا مِنْ أَصْحَابِ الدِّمَاءِ حَتَّى لَا يَبْقَى مِنْهُمْ أَحَدٌ مِنَ النَّاسِ بَعْدَ ذَلِكَ حَتَّى يَأْتِيَ الْمَقْتُولُ بِقَاتِلِهِ فَيَشْخُبَ دَمُهُ فِي وَجْهِهِ[3] فَيَقُولُ أَنْتَ قَتَلْتَهُ فَلَا يَسْتَطِيعُ أَنْ يَكْتُمَ اللَّهَ حَد

يُغَرَّمُ قِيمَتَهُ وَ يُضْرَبُ ضَرْباً شَدِيداً[4] وَ قَالَ فِي رَجُلٍ قَتَلَ مَمْلُوكَهُ قَالَ يُعْتِقُ رَقَبَةً[5] وَ يَصُومُ شَهْرَيْنِ مُتَتابِعَيْنِ وَ يُطْعِمُ سِتِّينَ مِسْكِيناً ثُمَّ التَّوْبَةُ بَعْدَ ذَلِكَ[6].
