إِنَّمَا جُعِلَتِ الْقَسَامَةُ احْتِيَاطاً لِلنَّاسِ لِكَيْمَا إِذَا أَرَادَ الْفَاسِقُ أَنْ يَقْتُلَ رَجُلًا أَوْ يَغْتَالَ رَجُلًا حَيْثُ لَا يَرَاهُ أَحَدٌ خَافَ ذَلِكَ فَامْتَنَعَ مِنَ الْقَتْلِ‌[3].

"The practice of Qasamah was established as a precaution for people so that if a wicked person intended to kill or assassinate someone where no one could see him, he would fear this ruling and refrain from committing murder."

"While the Messenger of Allah (swt) (peace be upon him and his family) was in one of his rooms, a man peeked through a crack in the door. The Messenger of Allah (swt) (peace be upon him and his family) had a combing stick in his hand and said: 'If I were close to you, I would have gouged out your eye with it.'"

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنْ رَجُلٍ اطَّلَعَ عَلَى قَوْمٍ لِيَنْظُرَ إِلَى عَوْرَاتِهِمْ فَرَمَوْهُ فَقَتَلُوهُ أَوْ جَرَحُوهُ أَوْ فَقَئُوا عَيْنَهُ فَقَالَ لَا دِيَةُ لَهُ إِنَّ رَسُولَ اللَّهِ ص اطَّلَعَ رَجُلٌ فِي حُجْرَتِهِ مِنْ خِلَالِهَا فَجَاءَهُ رَسُولُ اللَّهِ ص بِمِشْقَصٍ لِيَفْقَأَ بِهِ عَيْنَهُ‌[1] فَوَجَدَهُ قَدِ انْطَلَقَ فَنَادَاهُ يَا خَبِيثُ لَوْ ثَبَتَّ لِي لَفَقَأْتُ عَيْنَكَ بِهِ.

كَانَ صِبْيَانٌ فِي زَمَنِ أَمِيرِ الْمُؤْمِنِينَ ع يَلْعَبُونَ بِأَخْطَارٍ لَهُمْ‌[5] فَرَمَى أَحَدُهُمْ‌ بِخَطَرِهِ فَدَقَّ رَبَاعِيَةَ صَاحِبِهِ فَرُفِعَ ذَلِكَ إِلَى أَمِيرِ الْمُؤْمِنِينَ ع فَأَقَامَ الرَّامِي الْبَيِّنَةَ بِأَنَّهُ قَدْ قَالَ حَذَارِ فَدَرَأَ أَمِيرُ الْمُؤْمِنِينَ ع عَنْهُ الْقِصَاصَ ثُمَّ قَالَ قَدْ أَعْذَرَ مَنْ حَذَّرَ.

"During the time of the Commander of the Faithful (as), some children were playing with their arrows. One of them shot his arrow and broke his companion's front tooth. سَمِعْتُ أَبَا عَبْدِ اللَّهِ ع يَقُولُ‌ فِي رَجُلٍ أَرَادَ امْرَأَةً عَلَى نَفْسِهَا حَرَاماً فَرَمَتْهُ بِحَجَرٍ فَأَصَابَتْ مِنْهُ مَقْتَلًا قَالَ لَيْسَ عَلَيْهَا شَيْ‌ءٌ فِيمَا بَيْنَهَا وَ بَيْنَ اللَّهِ عَزَّ وَ جَلَّ فَإِنْ قُدِّمَتْ إِلَى إِمَامٍ عَدْلٍ أَهْدَرَ دَمَهُ‌[1].

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ع عَنْ رَجُلٍ ضُرِبَ بِعَصاً فَلَمْ تُرْفَعْ عَنْهُ حَتَّى قُتِلَ أَ يُدْفَعُ الْقَاتِلُ إِلَى أَوْلِيَاءِ الْمَقْتُولِ- قَالَ نَعَمْ وَ لَكِنْ لَا يُتْرَكُ أَنْ يُعْبَثَ بِهِ‌[1] وَ لَكِنْ يُجَازُ عَلَيْهِ‌[2].
